A US judge has denied a request by lawyers for the doctor convicted of causing Michael Jackson's death to have an independent laboratory test the contents of a key vial of evidence.

Just days before the scheduled sentencing of Dr Conrad Murray, Superior Court Judge Michael Pastor said defence lawyers could have sought the testing months ago or even during the doctor's six-week trial.

"You're not involved in fishing, you're involved in foraging," Judge Pastor said.

Murray's lawyers wanted a lab to test a small amount of liquid found in a vial of the anaesthetic propofol that authorities contend was used to help Jackson sleep on the day he died.

Defence lawyer J Michael Flanagan argued the results would reveal the accuracy of a theory by a prosecution expert who testified that Murray left Jackson's bedside while the singer was on an IV drip of propofol and the painkiller lidocaine.

Murray had been giving Jackson nightly doses of propofol to help the singer sleep as he prepared for a series of comeback concerts.

Deputy District Attorney David Walgren contended there was no legal basis for the testing and said Murray received a fair trial.

Judge Pastor examined the propofol vial, which was found in the closet of Jackson's bedroom, before issuing his ruling.

Mr Flanagan said it didn't occur to him that the contents of the vial should be tested until after the conclusion of Murray's trial, which ended on November 7 with the conviction of the cardiologist on an involuntary manslaughter charge.

Mr Flanagan said if prosecution expert Dr Steven Shafer's theory is correct, the small amount of liquid that remained in the vial should contain lidocaine. In that case, "that's the ballgame" and would prove Murray did leave the singer alone on an IV drip, Mr Flanagan said.

Mr Flanagan also argued that Dr Shafer didn't tell jurors that he believed Murray injected lidocaine into the propofol vial until Dr Shafer was called as a rebuttal witness in the final moments of testimony.

Mr Walgren said Dr Shafer and other witnesses acknowledged that they didn't know exactly what happened in Jackson's bedroom before the singer's death on June 25, 2009. Dr Shafer was one of several experts who told jurors that he could only theorise on events based on toxicology results, Murray's statements to police and evidence found at the scene.

"Whether there was lidocaine in that bottle or not is completely irrelevant," Mr Walgren said.

Murray is set to be sentenced on November 29. Mr Walgren said he is finalising work on a sentencing memorandum and several people may speak during the hearing. He did not say whether members of Jackson's family, several of whom attended the trial daily, would offer statements.

Murray remains jailed and faces a possible sentence ranging from probation to up to four years.

Sentencing is scheduled for Nov. 29, next Tuesday, at 8:30 am PT.

On another note, Judge Pastor approved our request for cameras to film sentencing of Dr Murray. We'll live stream the entire hearing.

Defense attorneys will be arguing for probation only as sentencing without any jail time. Prosecutor will probably ask for max time of 4 yrs

Defense attorneys will most likely use this ruling in the appeal process. Attorneys have until Wed to file their sentence recommendation.

If Lidocaine was not found mixed w/ Propofol defense attorneys would make a motion for new trial based on newly found evidence.

Judge Pastor denied the defense request saying they should've asked for this testing a long time ago.
Attorneys said that if Dr. Steven Shafer's theory about infusion is correct, there should be Lidocaine mixed w/ Propofol in the 100ml bottle

Dr. Conrad Murray has told his lawyers that he wants to formally address the court and Los Angeles Judge Michael Pastor at his upcoming sentencing hearing in the Michael Jackson death case, RadarOnline.com is exclusively reporting.

Murray was convicted of involuntary manslaughter in the King of Pop's shocking death and is currently behind bars pending the hearing slated for Tuesday, November 29


My comment: Now this tabloid changes the it talks about Michael's deaht.. in the King of Pop's shocking death.... before was quite different.

The doctor -- who has had his medical license in California yanked -- has told his legal team that he will be speaking at the sentencing hearing.

"Dr. Murray wanted to testify, and feels that if he had, there is no way he would have been convicted. Murray is livid that his lawyers didn't put him on the stand and has said he plans on pleading with Judge Michael Pastor for mercy. Murray will admit no guilt, and not take any responsibility for his actions. Murray plans on appealing and wants the judge to give him probation only for killing Michael Jackson," a source close to the situation says.


My comment: Weird, the judge said to Murray the decision to take the stand was only his, now he wanted to take the stand??

Well, by the documentary it would help the prosecution.

As RadarOnline.com previously reported, Murray's decision to participate in a documentary about the trial could be used at his sentencing hearing.

The convicted felon sat down with the Today Show before being found guilty of killing Jackson on June 25, 2009.

"I don't feel guilty, because I did not do anything wrong, I am very, very sorry for the loss of Michael... Michael is a personal friend. It's heartfelt. It's been painful," Murray told Today's Savannah Guthrie.

Murray's interview with Guthrie and a British reporter, as well as the documentary, which aired in the U.S. on MSNBC, could be played by the District Attorney during the proceedings

It's expected that several Jackson family members will make victim impact statements at the hearing, and Michael's children could write letters to the judge that could be read aloud in court by the Jacksons.

Prosecutors in the Conrad Murray manslaughter case are asking Judge Michael Pastor to order the doc to pay Michael Jackson's children more than $100 million for their loss.

According to new court docs filed by the D.A., Michael Jackson's kids are "entitled to wages or profits lost due to injury incurred by the victim."

Prosecutors say MJ's 3 kids are victims under the law, and are entitled to restitution from Dr. Murray ... which include wages, lost profits and funeral expenses. The D.A. cites a letter from the MJ Estate, estimating Michael would have made $100 million in revenue from the "This Is It" tour.

As we first reported, the D.A. is also seeking the maximum punishment -- 4 years in State Prison. The D.A. says they are seeking the max because Murray was "risking Mr. Jackson's life every night" by administering Propofol. And the D.A. says, MJ was a "particularly vulnerable victim." And the D.A. says, Murray lied and covered-up his crime.

The prosecutor in the Conrad Murray manslaughter case will ask Judge Michael Pastor to sentence the doctor to the maximum -- 4 years in State Prison ... TMZ has learned.

The D.A. just filed legal docs with the judge for the sentencing on Tuesday.

As we have already told you ... even if Murray gets 4 years, he will not spend a single day in prison because of a new California law. He will go to L.A. County Jail, where a 4-year sentence would be whittled down to 2 years. And, on top of that, Murray would be eligible for house arrest.

As we already reported ... Murray's lawyers will ask the judge to place him on probation.

Hmmm.. I don't know what to make about the DA request.. 100 milllion from someone in jail and in debt.

2 millions for concert. Cirque is making 2.5 million....Maybe this is the usual thing to do, but I thought that would be a kind of request for a civil case, by other hand:

In a separate court filing, defense attorneys for Dr. Conrad Murray, 58, sought to convince Los Angeles trial judge Michael Pastor to sentence their client to probation.

In seeking to justify their request for a maximum prison sentence of four years for Murray, prosecutors David Walgren and Deborah Brazil argued that the doctor took advantage of Jackson's trust in him, all while being under salary for $150,000 a month.

"Instead of utilizing his medical knowledge and training to provide Mr. Jackson with proper medical care, the defendant acted as an employee and as a drug dealer and completely corrupted the trust necessary in a proper doctor-patient relationship," prosecutors stated.


This paragraph reminded me of Fairy's last video and the Federal agents...

Defense attorneys said in their court papers that Murray's "background and character" warrant a sentence of probation, not prison time. They also cited his history of treating poor patients regardless of their ability to pay.

"Dr. Murray has been described as a changed, grief-stricken man, who walks around under a pail of sadness since the loss of his patient, Mr. Jackson," defense lawyers stated.

Prosecutor: Make doctor pay $100 million for Michael Jackson's death

When a judge sentences Dr. Conrad Murray next week for involuntary manslaughter in the death of Michael Jackson, he can choose anything from simple probation to up to four years in prison plus a hefty payment.

Prosecutors, in a sentencing memo filed this week, asked for the maximum, four years behind bars. They also want Murray to pay Jackson's children more than $100 million in restitution.

Defense lawyers, in their filing, asked for probation, not prison time, in light of the "manifold collateral consequences" Murray is suffering because of the felony conviction, including the loss of his medical career.

Murray has "displayed a complete lack of remorse" about Jackson's death, and is "even worse, failing to accept even the slightest level of responsibility," deputy district attorneys David Walgren and Deborah Brazil wrote in a sentencing memorandum filed Wednesday.

The prosecutors cited Murray's decision not to testify in his own defense, even while he was giving interviews for a documentary that aired days after the verdict.

"In each of these interviews, the defendant has very clearly stated that he bears no responsibility for Michael Jackson's death," the prosecutors said. "Moreover, the defendant has continued to express concern only for his individual plight and portrays himself, not the decedent, as the victim."

"I don't feel guilty because I did not do anything wrong," Murray said in the documentary quoted by the prosecution.

"Finally, the defendant consistently blames the victim for his own death, even going so far as to characterize himself as being 'entrapped' by the victim and as someone who suffered a 'betrayal' at the hands of the victim," the prosecutors said.

The prosecutors contend in their sentencing memo that Murray should be ordered to pay Jackson's three children restitution for the subsequent "wage and profits lost," as provided under California's "victim's bill of rights" law.

"The (Michael Jackson) estate estimates Michael Jackson's projected earnings for the 50-show O2 concert series to be $100,000,000," the prosecutors said.

With nearly $2 million in funeral expenses and 10% interest added each year, the prosecution is asking Pastor to order Murray to pay Prince, Paris and Blanket Jackson more than $120 million in restitution.

While it is doubtful that Murray, who is unlikely to ever practice medicine again, could pay much of that sum, it could prevent him from reaping financial benefits from any books, interviews or film projects in the future.

The defense sentencing memo asking for probation and no jail time included a biography of Murray that described him as "a self-made man of humble origins."

"He was raised in a home that lacked indoor plumbing or electricity, and he walked to school barefoot for his first couple years of school," the defense said.

Murray paid his own way through medical school without scholarships or family funds, it said.

He worked as a doctor for 20 years, with "no prior contacts with the law," and many of his patients were elderly in low-income, underserved communities, the defense said.

"It seems reasonable that the transgression for which he is to be judged should be viewed within the context of the larger life of which it is a part," it said.

The defense filing challenges the prosecution's contention that Murray is not remorseful.

"Dr. Murray wishes to make it unmistakenly clear to everyone that he deeply mourns the loss of Michael Jackson's life, and he profoundly regrets any mistakes or oversights on his part that may have contributed to it," the defense said.

The judge should also consider "the manifold collateral consequences that Dr. Murray has sustained as a result of his mistake," the defense said, including the loss of his medical career, the public disgrace and loss of privacy.

The defense memo included a letter from Murray's elderly mother, Milta Rush. She sat in court for much of her son's trial, just a few feet away from Katherine Jackson, the mother of Michael Jackson.

"I sympathize with Mrs. Jackson as a mother," Rush wrote in a letter to the judge. "I sense she was very close to her son. I really wanted to approach her personally and tell her I am sorry for the loss of her son but I was unsure if she would be receptive, and I did not want to take the chance of violating court rules. I am sorry for all her loss."

While Murray's mother told the judge her son is "saddened and remorseful" about Jackson's death, she said "his compassion and his soft heartedness for others led to this dilemma."

The defense contends that Murray was trying to help Jackson, who was desperate for sleep so he could be ready for rehearsals. "His compassionate intentions should not be overlooked," it said.

"The victim was a willing recipient of the medications administered," the defense said. "In fact, Mr. Jackson had repeatedly begged Dr. Murray for propofol to overcome his insomnia so that he could sleep."

"Dr. Murray is clearly such a defendant," the defense said. "He is an individual who remained free on bond for more than two years prior to the jury verdict, adhering assiduously to all of the bond conditions that had been imposed."

If Murray takes up a state prison or county jail cell, it "may mean that someone else with higher potential for violence will be released," the defense said.

Instead, the defense proposed that Murray could be sentenced to community service along with probation.

"Though he will perhaps not again be a doctor qualified to make diagnoses, he could educate and counsel patients about heart care and disease prevention," it said. "There are many non-profit clinics and organizations that would benefit from his participation, if ordered to perform community service as a condition of his sentence and a means of 'putting some water back into the public well.'"

I was thinking about these news and wondering about how is a big deal the charge Murray 120 million, knowing he does not have money to pay it:

The word: "financial benefists" in this article and "alive" from the hoax kind of made sense together.

We know "MJ estate" or "Michael's family" didn't cash any money from any insurance policy. The money MJ estate is making is from selling the brand "Michael Jackson" which the Estate would make Michael being dead or alive.

So NO "financial benefits" from the death.

Now at Murray's case, if Murray is really innocent and is helping Michael with the hoax, any documentary, book or film projects would characterize a "financial benefit" from the "death" and this could be trouble when Michael comes back.

They said Murray didn't make any money from the documentary, also.

We know that the Estate made 280 million from This is It movie, so 100 million they are asking is not even close to what they already made..

Also the 100 million, 2 million per concert, I don't think this is a good estimation for Michael's live concert. Cirque is doing 2.5 million per night, in smaller venius than O2 Arena and without Michael's "presence". Michael would do a lot more than that each night.

So I was wondering if this thing with Murray and money could be a strategy to avoid him to have any financial benefit from a "fake" death, because MJ estate will not get this money from Murray, he does not have it.

LOS ANGELES (AP) — Prosecutors who depicted Michael Jackson's doctor as remorseless for the superstar's death urged a judge Wednesday to sentence him to four years in prison, while a defence lawyer said Dr Conrad Murray is in a prison of self-punishment and should receive probation.

The opposing sentencing memos were filed in advance of Dr Conrad Murray's sentencing hearing Tuesday. He has been in jail since he was convicted November 7 of involuntary manslaughter for Jackson's fatal overdose of the anesthetic propofol.

Prosecutors David Walgren and Deborah Brazil wrote that Murray has shown no remorse for Jackson's death and has placed blame on others, including Jackson himself. They cited a series of post-trial media interviews with Murray that they submitted to Superior Court Judge Michael Pastor on a DVD.

In one excerpt, Murray states, "I don't feel guilty because I did not do anything wrong."

"Finally, the defendant consistently blames the victim for his own death," said the prosecution brief, "even going so far as to characterize himself as being `entrapped' by the victim and as someone who suffered a `betrayal' at the hands of the victim."

Defense attorney Nareg Gourjian, citing letters of praise from Murray's former patients, said: "There is no question that the death of his patient, Mr. Jackson, was unintentional and an enormous tragedy for everyone affected. Dr Murray has been described as a changed, grief-stricken man, who walks around under a pall of sadness since the loss of his patient, Mr Jackson."

Gourjian said Murray will never stop punishing himself over Jackson's loss and, "In effect, he will be serving a form of life sentence. However, the offense was not willful nor intended. ... He is, by every account, immensely sorrowful and remorseful."

Murray was convicted after six weeks of testimony focusing on Murray's administration of the drug propofol, an anesthetic not intended for treatment of insomnia or for home use. While Jackson was under the influence of the drug, Murray admitted leaving the room, prosecutors noted. They said he abandoned his patient when he was the most vulnerable.

In their memo, prosecutors said Murray "acted as an employee and as a drug dealer and completely corrupted the trust necessary in a proper doctor-patient relationship."

Gourjian asked the judge to consider Murray's humble beginnings in Trinidad and his lengthy career of doing good during his practice in Houston.

"The transgression for which he is to be judged should be viewed within the context of the larger life of which it is a part," he said.

He also argued in his 45-page memo that current budgetary problems and overcrowding of prisons has made it necessary to release non-violent, non-dangerous offenders. "Dr. Murray is clearly such a defendant," he said.

Gourjian noted that because of constant death threats, Murray must be kept in solitary confinement, which is expensive.

"Conrad Murray still has the knowledge, capacity and motivation to be a source of healing in the world," Gourjian wrote. "Though he will perhaps not again be a doctor ... he could educate and counsel patients about heart care and disease prevention." He suggested that as a form of community service by the doctor.

Yes Fairy it was also in this line I was thinking about, Of course it could be the other way around too, I mean, Murray is really a bad guy. Murray's side in this war is still a mistery.

Because it didn't look like he was getting any before the guilty verdict. The only letters he mentioned in his documentary was letters of encouragement. Talking about his documentary, in the one year footage never was mentioned any threats to Murray.

Wouldn't be more dangerous outside the jail?

Maybe not with all the Federal agents around him.

Conrad Murray Faces Sentencing in Death of Michael Jackson

LOS ANGELES, Calif. (KTLA) -- Michael Jackson's doctor Conrad Murray is due back in court on Tuesday for sentencing, after being convicted of involuntary manslaughter in the pop star's death.

Murray faces up to four years in prison, but his attorneys have asked a judge to give the doctor probation and community service.

Murray's lawyers described Michael Jackson's death as "an isolated aberration to an otherwise exceptional medical career."


They claim Murray has already been punished severely by the loss of his medical license and with public contempt.

Murray is being held in a cell in the medical services building where there is a higher ratio of guards to inmates for his safety.

Lindsay Lohan's lawyer is coming to the defense of Conrad Murray ... claiming the Doc should NOT get the maximum sentence for manslaughtering Michael Jackson ... because it just wouldn't be fair.

With Murray's sentencing hearing set for tomorrow in L.A. -- we asked the effervescent Shawn Holley if Conrad deserves the 4 year prison sentence he's expected to receive.

Holley makes it clear she doesn't excuse Murray's "horrible" crime ... but claims he shouldn't get the full sentence because, "He has no record."

Here is a video from Shawn Holleys husband Dorian and what his thoughts were on Michaels last rehearsal night......just the usual story about Michael being healthy and having fun.He also says they were rehearsing at the Forum and then about 2 weeks at Staples Centre.............I thought they were only at Staples for a few days?.

Anyway this interview is worth a listen as he certainly has plenty to say.........and he seems very composed for someone who has lost a friend who he has known for over 20years.

Also his thoughts on the news about Michaels 'death'are interesting.....

Los Angeles (CNN) -- Dr. Conrad Murray, who was found guilty of involuntary manslaughter in the death of pop icon Michael Jackson, will be sentenced Tuesday.

Jackson's mother, Katherine, hopes Murray gets the harshest sentence possible: four years in a state prison.

"I don't believe that he intended for Michael to die," Katherine Jackson said Monday. "He was just taking a chance."

At the sentencing Tuesday, Los Angeles Superior Court Judge Michael Pastor has a choice ranging between probation and up to four years in a state prison. But measures to relieve California prison and jail crowding could significantly shorten his time locked up.

Prosecutors successfully argued that Murray's reckless use of the surgical anesthetic propofol to help Jackson sleep, without proper monitoring equipment, led to the singer's death.

Testimony during his trial revealed that Murray gave propofol nearly every night in the two months before the singer's death on June 25, 2009, as Jackson prepared for his comeback concerts set for London the next month.

Murray was found guilty three weeks ago.

Katherine Jackson and several of her children will be in court for the sentencing Tuesday, but her grandchildren Prince, Paris and Blanket will not. They'll be at school, she said.

She was uncertain whether anyone from the family would speak in court, but she was interviewed by a probation officer who will include her thoughts in the report to the judge, Jackson said.

Murray's mother, Milta Rush, wrote a letter to the judge asking for mercy, saying "his compassion and his soft heartedness for others led to this dilemma."

Prosecutors are asking for the maximum four years behind bars, and they want Murray to pay Jackson's children more than $100 million in restitution. Defense lawyers want probation, not prison time.

Each side will have a chance to present oral arguments Tuesday, but their positions were detailed in sentencing memos filed with the judge last week.

Murray has "displayed a complete lack of remorse" about Jackson's death, and is, "even worse, failing to accept even the slightest level of responsibility," deputy district attorneys David Walgren and Deborah Brazil wrote.

The prosecutors cited Murray's decision not to testify in his own defense, even while he was giving interviews for a documentary that aired days after the verdict.

"In each of these interviews, the defendant has very clearly stated that he bears no responsibility for Michael Jackson's death," the prosecutors said. "Moreover, the defendant has continued to express concern only for his individual plight and portrays himself, not the decedent, as the victim."

"I don't feel guilty because I did not do anything wrong," Murray said in the documentary quoted by the prosecution.

"Finally, the defendant consistently blames the victim for his own death, even going so far as to characterize himself as being 'entrapped' by the victim and as someone who suffered a 'betrayal' at the hands of the victim," the prosecutors said.

Jackson's death came as he was preparing for a series of comeback concerts in London, which the defense argued pressured the singer to seek sleep or risk having the concerts canceled.

The prosecutors contend in their sentencing memo that Murray should be ordered to pay Jackson's three children restitution for the subsequent "wage and profits lost," as provided under California's "victim's bill of rights" law.

The singer's "estate estimates Michael Jackson's projected earnings for the 50-show O2 concert series to be $100 million," the prosecutors said.

With nearly $2 million in funeral expenses and 10% interest added each year, the prosecution is asking Pastor to order Murray to pay Prince, Paris and Blanket Jackson more than $120 million in restitution.

While it is doubtful that Murray, who is unlikely to ever practice medicine again, could pay much of that sum, it could prevent him from reaping financial benefits from any books, interviews or film projects in the future.

Defense lawyers, in their sentencing memo, said Murray is suffering "manifold collateral consequences" because of the felony conviction.

The memo included a biography of Murray that described him as "a self-made man of humble origins," who paid his own way through medical school without scholarships or family funds.

"He was raised in a home that lacked indoor plumbing or electricity, and he walked to school barefoot for his first couple years of school," the defense said.

He worked as a doctor for 20 years, with "no prior contacts with the law," and many of his patients were elderly in low-income, underserved communities, the defense said.

"It seems reasonable that the transgression for which he is to be judged should be viewed within the context of the larger life of which it is a part," it said.

The defense challenges the prosecution's contention that Murray is not remorseful.

"Dr. Murray wishes to make it unmistakenly clear to everyone that he deeply mourns the loss of Michael Jackson's life, and he profoundly regrets any mistakes or oversights on his part that may have contributed to it," the defense said.

The judge should also consider "the manifold collateral consequences that Dr. Murray has sustained as a result of his mistake," the defense said, including the loss of his medical career, the public disgrace and loss of privacy.

"Dr. Murray has been described as a changed, grief-stricken man, who walks around under a pall of sadness since the loss of his patient, Mr. Jackson," the defense said.

The defense memo included a letter from Murray's elderly mother, Milta Rush. She sat in court for much of her son's trial, just a few feet away from Jackson's mother.

"I sympathize with Mrs. Jackson as a mother," Rush wrote in a letter to the judge. "I sense she was very close to her son. I really wanted to approach her personally and tell her I am sorry for the loss of her son, but I was unsure if she would be receptive, and I did not want to take the chance of violating court rules. I am sorry for all her loss."

Murray's mother also told the judge her son is "saddened and remorseful" about Jackson's death.

The defense contends that Murray was trying to help Jackson, who was desperate for sleep so he could be ready for rehearsals. "His compassionate intentions should not be overlooked," it said.

"The victim was a willing recipient of the medications administered," the defense said. "In fact, Mr. Jackson had repeatedly begged Dr. Murray for propofol to overcome his insomnia so that he could sleep."

Murray does not pose a safety threat to the public, it said. "The likelihood of recurrence is essentially nonexistent since Conrad Murray's medical license has been suspended."

Aside from the arguments of what Murray deserves, the defense contends that California's prison and jail crowding mean that "neither the space nor the public funds exist to continue imprisoning nonviolent, nondangerous offenders who do not need to be incapacitated for the sake of public safety."

"Dr. Murray is clearly such a defendant," the defense said. "He is an individual who remained free on bond for more than two years prior to the jury verdict, adhering assiduously to all of the bond conditions that had been imposed."

If Murray takes up a state prison or county jail cell, it "may mean that someone else with higher potential for violence will be released," the defense said.

Instead, the defense proposed that Murray could be sentenced to community service along with probation.

"Though he will perhaps not again be a doctor qualified to make diagnoses, he could educate and counsel patients about heart care and disease prevention," it said. "There are many nonprofit clinics and organizations that would benefit from his participation, if ordered to perform community service as a condition of his sentence and a means of 'putting some water back into the public well.'"

Maybe we will watch Murray's documentary again:

Dr. Conrad Murray may regret taking part in a recent documentary on Michael Jackson’s death and the resulting trial. Footage from the show (much of it not very flattering to Murray) may be used at his sentencing hearing on November 29.

In the interview, Murray is anything but remorseful. He maintained his innocence throughout the trial, but he goes even further in the interview, saying,

“I don’t feel guilty, because I did not do anything wrong,” although he says he is sorry for Michael Jackson’s loss as he considered him a personal friend.

Murray’s interview with Guthrie, and a British reporter, as well as the documentary which aired in the U.S. on MSNBC last Friday, could be played by the District Attorney at the sentencing hearing. That is completely legal.

The showing of the TV programs at the sentencing hearing could be very interesting as Murray told the investigating officers a wildly different series of events that took place to those he revealed during what was aired on TV.

Judge Pastor could sentence Murray to up to four years in state prison for the charges on which he has been convicted. His apparent inability to tell the truth, on a consistent basis, which is highlighted by these shows, might push the sentence to the max.

As we previously reported, the executors of Jackson’s estate, John Branca and John McClain, heavily criticized NBC for airing the documentary. Now they may be a whole lot happier. Far from glorifying the doctor, the shows painted a very negative picture of Conrad Murray

Dr. Conrad Murray's mother says she's "suffering" from overwhelming sadness because her only son is incarcerated -- and has begged the judge to go easy on the Doc when it comes to his sentence.

Mrs. Milta Rush sent a letter to Judge Pastor -- explaining why Murray deserves mercy ... because he's a good person who has "never drank alcohol, took drugs or smoked cigarettes in his life."

Milta explains, "He has never been in trouble with the law before and I am barely standing, scared and worried sick about him being incarcerated."

"He is saddened and remorseful about the death of his friend Michael Jackson and I do believe he is certainly learning the toughest lesson of his life."

Milta continues, "I sympathize with Mrs. Jackson as a mother; I feel her pain for having lost her son. I sense she was very close to her son. I really wanted to approach her personally and tell her I am sorry for the loss of her son but I was unsure if she would be receptive, and I did not want to take the chance of violating the courts rules. I am sorry for her loss."

"Judge Pastor, Conrad, is my son and as a mother I must say I know him inside out. He is sorry for what happened to Michael and had no intent towards him."

"I humbly beg for your heart felt consideration of everything I have said about Conrad, and ask for your compassion and leniency in giving him probation or community service."

Yeah I kinda think they were never that unhappy about it. It does paint a negative picture of Murray.

The whole protest to the documentary reminds me of the protest the Jackson family had about the recording of the funeral. A recording we have learned so much from in so many ways (green screen etc showing us that it was staged)

The protest made even more people watch the funeral even closer. As judge Michael Pastor said to the jurors about the black-out parts of the transcript of the Murray interview with the LAPD... "Its human nature that if someone tries to prevent you from seeing something you will really want to know what it is"... Controversy.... one of Michael's favorite talents..

Michael Jackson's family is expected to watch from the courtroom as Conrad Murray is sentenced today in the death of Michael Jackson.

"I told them to be prepared for probation," Jackson family attorney Brian Oxman told ABCNews.com.

Oxman said the Jackson family has experienced a "whole mixture of terrible emotions." Originally, the family, including matriarch Katherine Jackson, wanted the book thrown at Murray. Now, post-conviction, Katherine and daughter La Toya are saying, "It doesn't change anything," Oxman said.

Though family members plan to be in court for the sentencing, scheduled for 8:30 a.m. in Los Angeles, Oxman is uncertain whether any of them will speak before Judge Michael Pastor.

The judge does reserve the right to turn off cameras during the hearing, such as in the case of Jackson's children Prince Michael and Paris, who saw their father unconscious, testifying. A court spokesman would provide no information on who will address the court.

Earlier this month, a jury found Murray guilty of involuntary manslaughter in Jackson's June 25, 2009, death.

"He's been serving his sentence since June 25, and it's more powerful than anything the judge can do to him," said Oxman, who first met Murray in UCLA's emergency room where doctors tried but failed to revive Jackson. "I saw a man who's life completely flashed before him. I don't see him as a cold, calculating killer. He did some horribly dumb things."

Murray faces anything from probation to four years in state prison.

"If the Anna Nicole Smith trial is any indication, probation is in the works," Oxman said.

In that case, prosecutors recommended probation for Smith's psychiatrist, Khristine Eroshevich, who was convicted of obtaining medication by fraud for the model who died of a drug overdose.

In Murray's case, however, the district attorney is asking for the maximum sentence of four years as well as $100 million -- the singer's projected earnings from the 50-show "This Is It" tour -- payable to the Jackson estate. The prosecution is also asking Murray to pay $1.8 million in costs associated with Jackson's memorial service and funeral.

In their memo to the judge, prosecutors paint Murray as a callous physician who knew he was doing wrong by administering propofol to Jackson, took pains to hide it and left his patient in a vulnerable state.

"The defendant [Murray] acted as a drug dealer and completely corrupted the trust necessary in a proper doctor-patient relationship," the memo stated.

Murray's attorneys filed a 45-page memo asking that the judge "impose a sentence of probation with substantial community service," taking into account that the doctor has no criminal record, will most likely never practice medicine again and has already been publicly disgraced.

The defense memo highlights Murray's humble beginnings in Trinidad and stresses his dedication to the medical profession and his love for his family, including his seven children, which has been "strained close to the breaking point." Along with it, the defense provides 56 pages of letters from Murray's former patients, family members and ministers.

Though Oxman has prepared the Jackson family for a sentence of probation, he thinks Murray will get at least some jail time -- a year, possibly two years, of which he'll serve at least half.

"If the judge was thinking of probation he wouldn't have remanded him to custody," Oxman said.

Murray was cuffed and taken into custody following the Nov. 7 verdict. He has spent the last three weeks in jail.

Humm... I don't think so. I don't see Oxamn and Joe going after AEG.

Maybe Oxman is preparing the ground for Joe/Oxman association with Murray at Joe lawsuit against Murray. In this lawsuit was said Oxman and Murray's defense would join forces to get other doctors involved in the lawsuit. I don't know.

I don't see Oxman as a good lawyer (it seems his license is suspended), and I don't see Oxman playing against the bad guys. I have my doubts.


Marlon Jackson God Will Punish Conrad Murray

Michael Jackson's older brother Marlon wants Judge Pastor to throw the book at Dr. Conrad Murray today -- but he insists Conrad's real punishment will come from God himself.

Marlon flew in to LAX yesterday -- presumably for today's sentencing hearing -- and told us he hopes Murray gets the maximum sentence ... but explains, "The real verdict will come down not on planet Earth ... the Lord will take care of what he needs to take care of."

Conrad Murray He Could Get More Time Because He Killed MJ

Judges, proseuctors and criminal lawyers who have spoken with TMZ agree ... Conrad Murray should not get the maximum sentence -- 4 years in prison -- but the fact that he killed Michael Jackson changes everything.

It's not supposed to be this way -- the fame of the victim should be irrelevant -- but it's hard to ignore the fame of the victim.

The people we spoke with say the typical sentence for someone in a similar position -- no criminal history, an otherwise unblemished record -- would be a "blended sentence" -- a year or 2 in jail, and then a year or 2 of community service.

Judge Michael Pastor made it clear when he denied Murray bail -- he views the crime as extremely serious, possibly telegraphing a maximum sentence. It's hard to tell what Pastor will do, but almost everyone considers him a fair but stern judge.

The fact that the D.A. is asking for $100 million in restitution shows how much of a difference it makes that MJ is the victim. The reality is -- in terms of money -- Michael is worth more dead than alive, so there should be no restitution. His 3 kids will now get hundreds of millions in a windfall.

Here's the reality ... Murray will not serve a day in prison. Because of a new California law, any time he gets will be served in L.A. County Jail, and the amount of time will automatically be cut in half. And, Murray would be eligible for house arrest.

In number one it is said Michael Jackson should be seen as anyone else and the fact the he is rich and famous shouldn't be considered.

However, in numbe 2, the fact that Michael Jackson is rich and famous should be considered, like "killing" him was a favor to his children which will have more money because of his "death".

TMZ has obtained Dr. Conrad Murray's mug shot ... taken moments after he was convicted of manslaughtering Michael Jackson on Nov. 7.

Conrad remained in custody during today's hearing -- so he isn't expected to pose for a new mug shot, now that he's been sentenced to 4 years behind bars.

Conrad Murray sentenced to four years in Jackson death

LOS ANGELES –

The doctor convicted of killing Michael Jackson was sentenced to four years in jail on Thursday.

In scathing words Superior Court Judge Michael Pastor described Dr. Conrad Murray as "reckless" and a liar, someone who is a "danger to the community" with "no sense of remorse and no sense of fault" for Jackson's death.

Calling him "a disgrace to the medical profession … an honorable profession which bears the scourge of what happened here," Pastor also ruled that Murray would be required to make restitution to be determined at a later date to the estate of Jackson, his children and other family members.

The judge repeatedly chastised Murray for what he called a "horrific violation of trust" while caring for Jackson.

"Experimental medicine is not going to be tolerated and Mr. Jackson was an experiment," Pastor said. "The fact that (Jackson) participated in it does not excuse or lessen the pain for Dr. Murray who simply could have walked away or said no as countless others did."

Murray, 58, did not speak on his behalf and sat stone-faced with his hands crossed through the sentencing hearing which began with a collective statement from the Jackson family read by attorney and family friend Brian Panish.

There "no way to adequately describe the loss of" Jackson, the statement said and it questioned whether it is "really possible that he is gone?"

"It is simply against the natural order of things," the statement said.

"There is nothing you can do today that will bring Michael back," the statement said. But the family asked for "justice" and prosecutor Ed Chernoff said that in a pre-sentencing interview mother Katherine Jackson asked for the maximum four years allowed by law.

Several members of Jackson's family, including Katherine and siblings LaToya, Jermaine, Randy and Rebbie, attended the proceedings.

Murray's mother and girlfriend also attended the sentencing hearing.

Pastor said one of the most disturbing aspects of the case — "one aspect stands out the most" — was "the surreptitious recording of Michael Jackson by his trusted doctor." The slurred recording of Jackson was recovered from the doctor's cell phone.

"I have repeatedly asked myself why this happened and for what reason?" Pastor said, adding that he could only speculate that the recording was "Dr. Murray's insurance policy."

"It was designed to record his patient surreptitiously at that patient's most vulnerable point," Pastor said. "I can't even imagine that happening to any of us because of the horrific violation of trust, and I can't help but wonder that if there had been conflict" between Dr. Murray and Jackson "what value would have been placed on that tape recording."

Lead defense attorney Ed Chernoff highlighted the accomplishments of Murray.

"I do wonder though to what extent the court considers the entirety of a man's book of life, as opposed to one chapter," he told the judge.

Jail time for Murray wouldn't change things, Chernoff said.

"Whether he's a barista for the rest of his life, whether he's a greeter at Walmart, he's still going to be the man that killed Michael Jackson," Chernoff said.

Jackson died in a bedroom at his mansion on June 25, 2009, of an overdose of the surgical anesthetic propofol. Murray was convicted Nov. 7 of involuntary manslaughter after a six-week trial. Jurors found that Murray caused Jackson's death through criminal negligence. Prosecutor David Walgren argued that Murray violated medical standards in using propofol as a sleep aid at Jackson's home without proper monitoring and resuscitation equipment. Walgren said Murray delayed for 20 minutes before phoning 911 and lied to rescue personnel about what drugs he gave.

After the verdict was delivered, Pastor said the doctor posed a danger to society and ordered him handcuffed and removed to jail pending sentencing. Murray spent three weeks in the Twin Towers county jail facility in downtown Los Angeles.

Involuntary manslaughter, the least serious form of homicide in California, carries a maximum sentence of four years in prison. But because of a change in state law he will serve his term in the county jail and could be released much sooner because of overcrowding.

In papers filed with the court Nov. 23, prosecutors asked Pastor to give Murray the maximum prison term and order him to pay restitution of $101.8 million to Jackson's estate. That amount would represent the $100 million the pop star would have earned from the 50-concert This Is It comeback series in London for which he was rehearsing, and $1.8 million in funeral and memorial service costs.

Also, the prosecutors said, Murray should get a stiff sentence because he showed no remorse in TV interviews, including a Today Show appearance where he said, "I don't feel guilty because I did not do anything wrong."

In a filing by the defense, lawyer Nareg Gourjian asked Pastor to sentence Murray leniently, to probation. Jackson's death was "an atypical and isolated aberration to an otherwise exceptional medical career," Murray's lawyers said. The likely loss of Murray's medical licenses in four states, and public contempt that included death threats, was punishment enough, the attorneys said.

"Dr. Murray's life will never be the same," the plea for probation said. "He will forever be stigmatized as the doctor responsible for the death of Michael Jackson."

Los Angeles County District Attorney Steve Cooley said after the verdict that Murray as a non-violent offender probably would spend any imprisonment in a county jail rather than a state penitentiary under a recent change in state law. County prisoners often are released short of their sentence terms to relieve overcrowding.

Conrad Murray's defense attorney J. Michael Flanagan just stormed away from a news conference -- after he was ambushed by hecklers.

Flanagan was in the middle of making a statement, claiming, Murray "led 56 years of exemplary life" -- at which point he was interrupted by someone in the crowd ... "And then he killed Michael Jackson."

Flanagan asked for the hecklers to be removed ... but after nothing happened, Flanagan said, "I'm out of here."

The Michael Jackson estate believes Dr. Conrad Murray got his just deserts when Judge Pastor sentenced him to 4 years in the clink today -- telling TMZ the sentence was "appropriate and called for."

Howard Weitzman, lawyer for the estate, released a statetment ... saying, "The egregious conduct of Dr. Murray when 'treating' Michael Jackson was bad enough ... but when coupled with his outrageous lies in trying to cover up his wrongdoing after Michael was dying and/or had died only served to magnify his criminal actions."

The rep adds, "Michael Jackson was one of the greatest entertainers that ever lived and he will be missed by millions."

Katherine Jackson says immediately after Michael Jackson was pronounced dead, his daughter Paris was crying, saying, "I wanna go with you." -- this according to the official Probation Report obtained by TMZ.

In the report, Katherine lashes out at Murray for his documentary, in which he lays blame for MJ's death on the singer and not Murray himself. The report says, "During filming, he repeatedly stated that he did nothing wrong. Ms. Jackson feels this adds insult to injury, and shows that he is clearly not remorseful."

Katherine feels a 4-year sentence is "insufficient."

Katherine also says she was "deeply insulted" that on the anniversary of Michael's death, Murray arranged to be photographed at the cemetery.

Los Angeles County's jails could run out of space as early as next month because of an influx of state prisoners, prompting officials to consider releasing potentially thousands of inmates awaiting trial.

The state's new prison law, which establishes a practice known as realignment, is expected to send as many as 8,000 offenders who would normally go to state prisons into the L.A. County Jail system in the next year.

Currently, defendants awaiting trial account for 70% of the jail population, but Sheriff Lee Baca said that might need to drop to 50%. The department is studying a major expansion of its electronic monitoring and home detention programs to keep track of inmates who are released.

Baca said the department is also developing a new risk-assessment system designed to better identify which inmates are the best candidates to leave the jails.

Additionally, the department is looking at ways to channel more offenders into education and substance abuse programs rather than jail.

An internal report produced by the L.A. County district attorney's office and obtained by The Times estimated that the county jails would be full by the end of the year. The Sheriff's Department has the funding to open only an additional 1,800 beds, far below the number needed to accommodate the tide of state prisoners coming its way, the report said.

The realignment plan, developed to comply with a U.S. Supreme Court decision on overcrowding in the state prison system, has generated dire warnings from local police and prosecutors who fear the shift will place more offenders on the streets and increase crime. Los Angeles Police Chief Charlie Beck has predicted that the city could see a 3% increase in crime because of realignment.

There is special concern about releasing more defendants before trial, with prosecutors fearing that some might not show up in court. Dist. Atty. Steve Cooley said he also worries that inmates on electronic monitors could intimidate witnesses or take other actions to disrupt their trials.

Cooley used the conviction of Michael Jackson's personal physician for involuntary manslaughter to highlight the risks realignment brings.

Conrad Murray faces up to four years in prison. But under the realignment law, he would spend that sentence in a county jail rather than a state prison. That's because under the law, involuntary manslaughter as well as crimes such as drug offenses and identity theft no longer require state prison time.

Cooley said that if the County Jail system reaches capacity, Murray could be a candidate for early release.

"There is going to be a tremendous number of people that should be in jail and will not be incarcerated," he said. "This is the kind of story that will play out over and over again."

Baca declined to comment specifically on what will happen to Murray. But he said the doctor's case shows the decisions his department will probably be forced to make as officials determine which inmates can be released.

"Let's face it, Dr. Murray, for quite a period of time, was out free before he was convicted," Baca said. "The chances of him being a problem behaviorally or a threat to society is nonexistent. He's not probably going to practice medicine again or prescribe medication."

Early release of inmates from the County Jail system has been a reality for years.

The jails are under a federal court order to prevent overcrowding, forcing the Sheriff's Department to release inmates before they serve their full sentences. The extent of early release has fluctuated over time, depending on funding issues and the size of the jail population.

Between 2002 and 2006, more than 150,000 inmates walked free after serving a fraction of their sentences — many of them less than 10%. A 2006 Times investigation found that almost 16,000 inmates released early were rearrested while they were supposed to still be in jail. Sixteen were charged with murder.

More recently, sheriff's officials said they've reduced the number of early releases. But as the cases of Paris Hilton and Lindsay Lohan have shown, low-risk offenders still often serve a small fraction of their sentences. Lohan was sentenced to 30 days in jail, but ended up serving only five hours this week.

The Sheriff's Department has hired a consultant to study, in conjunction with the American Civil Liberties Union, ways of better determining which inmates awaiting trial could be safely released from jail.

Baca said he knows that the prospect of early releases is generating fear and frustration. But given the state law, the sheriff said he is focusing how to handle realignment in the safest and most judicious way.

"I make do with what I can, and I've tried to be creative," Baca said.

Prosecutors, however, are wary of the changes.

The "bottom line is that there is no more room at the inn," Cooley said.

I was posting the video when you posted Fairy.. hehehe..

Yeah good points. About the suit Murray is wearing at the mugshot, if it is a mugshot and it does not match with the suit he wore at Nov 7 could be a mistake from TMZ.

I was looking for the suit he wore at Feb 2010 during the arrest to see if could be the same, but so far I didn't find a good picture to compare:

Note to Conrad Murray's mom. You were wrong when you told Judge Michael Pastor your son never had a drink in his life, and we have the proof -- 80 proof.

Murray's mom wrote a letter to Judge Michael Pastor before his sentencing, pleading for mercy for her son and claiming Conrad is a good person who "never drank alcohol, took drugs or smoked cigarettes in his life."

But here's the deal. We got this pic of the Doc, who was at a holiday bash in Vegas in the late '90's. You see Murray triple fisting. People at the party tell us Murray was drinking champagne and cocktails all night long.

At least he won't get extra jail time for this lie.

Dr. Murray Prosecutor Conrad Should've Stayed AWAY from 'Today' Show

Dr. Conrad Murray NEVER should have agreed to be interview by "Today" ... because the "complete lack of remorse" he demonstrated on the show made him look even more guilty ... this according to the rock star attorney who prosecuted the doc.

Deputy District Attorney David Walgren appeared on "Today" this morning -- and said Murray showed a "complete lack of personal responsibility" in an interview with co-host Savannah Guthrie that aired days after the conviction ... insisting there's no way it could've helped Murray's case.

Murray was all over the place during the interview -- contradicting the story he originally told police and then proclaiming, "I didn't do anything wrong!"
