Michael Jackson doctor Conrad Murray seeks bail while waiting on appeal
Los Angeles (CNN) -- The doctor convicted of causing Michael Jackson's death asked an appeals court this week to let him out of jail while the judges decide whether they will overturn his conviction.
The judge who presided over Conrad Murray's trial last year denied bail in a February hearing, saying his lawyers had not proven he was not a risk to flee the state or harm someone else with his questionable medical practices.
Jackson died of an overdose of a surgical anesthetic and sedatives in his home while under Dr. Murray's care on June 25, 2009.
Los Angeles County District Judge Michael Pastor, who sentenced Murray to four years in prison for the involuntary manslaughter conviction, "unjustifiably erred" by denying Murray's request to remain free during his appeal," Murray lawyer Valerie Wass said in a motion filed this week with California's Second District Court of Appeals. Appellant respectfully requests that this court order his release on his own recognizance pending appeal, or alternatively, that it order his release on reasonable bail," Wass wrote.
Murray, who has been in a Los Angeles County jail since a jury found him guilty in November 2011, is eligible for parole after serving two years. Murray is set to be freed October 28, 2013 unless he is let out early on bail or because of jail overcrowding.
Pastor said he doubted Murray would stick around for the appeal decision because he has "resources" to flee and "significant ties elsewhere," including to Grenada, where he was born, and Trinidad, where he was raised.
But Murray is a naturalized U.S. citizen with children in the United States, including a 3-year-old son in California, Wass argued in her motion for bail. The prospect of losing his life in the United States would prevent him from leaving the country, she said.
"It would be all but impossible for appellant to flee" because he has become infamous from the media coverage of Jackson's death and the trial, Wass wrote.
As for resources, Murray is broke, she said.
Pastor also suggested Murray was a danger to the public because of his dangerous attitude toward using propofol, the drug that killed Jackson.
Wass argued in the appeal that Murray would not be practicing medicine since California suspended his medical license after he was convicted and he voluntarily surrendered his other medical licenses in Texas and Nevada. "He lacks the means and ability to prescribe or obtain pharmaceutical drugs," she wrote.
Prosecutors have until the end of December to file their response to Murray's bail request. Murray is appealing his conviction on several points, including the contention that Pastor erred in not allowing his lawyers to present evidence of Jackson's financial troubles, which they argued would support their theory that the pop star's desperation led him to administer the fatal dose to himself.
Wass argued that the judge's decision not to allow the defense to call Beverly Hills dermatologist Dr. Arnold Klein or his staff as witnesses denied Murray a fair trial. Murray's lawyers contended that drugs given to Jackson by Klein in the weeks before his death contributed to his death.
The judge's refusal to sequester the jury in a hotel during the trial, which was televised live, "may have improperly influenced the jurors," Wass argued.
Another major issue in the appeal is the decision not to allow Murray's lawyers to test the contents of a bottle found next to Jackson's bed. They contend it could reveal evidence to support their theory that Jackson gave himself the fatal dose while Murray was out of the room. Jackson's mother and three children are suing AEG, the promotion company they say hired Murray and supervised Murray's care of Jackson as he prepared for comeback concerts in London in summer 2009. #conradmuray has still not filed an appeal brief, but has requested leave to file a reply to People's opposition to his bail motion. Silly
Very weird. The law says the person has 1 year to filed the brief for the appeal in court. Murray's deadline was November 2012. He asked for an extention and it was due at Dec 21. He didn't file the brief and without the brief the court cannot rule on the appeal. Now, the court has two options: 1) the dismissal of the appeal without futher notice or to give 15 days notice for dismissal.
I wonder why Murray is jeopardizing his chances for the appeal, looking instead for bail.

Conrad Murray Prosecutors Try to Block Bid for Freedom EXCLUSIVE
If prosecutors have their way ...Conrad Murray will stay locked up, even though an appeals court could reverse his manslaughter conviction in the death of Michael Jackson.
According to new court docs obtained by TMZ ... the California Attorney General is scoffing at Murray's bid for release pending appeal, arguing that he's totally unconvincing when he says he's not a flight risk. Murray is claiming if he gets out he'll live with his GF/baby mama Nicole Alvarez in Santa Monica, but prosecutors are quick to point out ... he has 7 kids with 5 women, which does not exactly make him the poster child of stability.
And get this ... Murray argued that he can't flee because he's a celeb and therefore can't run and hide. But prosecutors blanch at the doctor's argument, claiming it would be a travesty to reward him for becoming a celebrity by killing a true celebrity.
Prosecutors also say the fact that Murray has shown no remorse is a red flag that he might continue to be a danger to the community if set free.

Conrad Murray's Lawyers FIGHT During Jail Visit EXCLUSIVE
Conrad Murray went from star prisoner to star witness at the L.A. County Jail today ... when a FIGHT broke out between his lawyers during a jailhouse visit ... TMZ has learned.
Sources close to Murray tell us ... Murray had been complaining about pain in his right arm and shoulder for the past couple of days ... and today, two of his attorneys (who are each working on different cases) raced down to the jail to check in on The Doc.
The first to arrive was J. Michael Flanagan -- who reps Murray in all matters relating to the Michael Jackson manslaughter case. JMF arrived with his 30-year-old son Ryan, who's also a lawyer but isn't working on the Murray case.
After the Flanagans began to visit with Murray in the jail, Murray's other attorney, Valerie Wass, showed up. Wass reps Murray in all matters relating to the California Medical Board and the appeal of his criminal conviction.
According to our sources, Wass claims she tried to enter the visitation room to speak to Murray, but was physically blocked -- and pushed -- by Ryan. Wass claims Ryan and his dad proceeded to shout at her until they left.
We're told Valerie eventually got to meet with Murray --and immediately afterward, she filed a battery report against Ryan.
As for The Doc, one source tells us Murray witnessed the whole thing -- and if there's an investigation, he could play a key role in the case.

Dr. Conrad Murray's CRYING VOICEMAIL I'm in Constant Pain EXCLUSIVE
Jail has broken Dr. Conrad Murray ... physically and mentally ... this according to The Doc himself, who's been calling everyone he knows HYSTERICALLY CRYING and complaining that he's in "constant pain."
TMZ has obtained one of the voicemails Murray recently left for a friend ... in which he sobs uncontrollably and begs for someone to save him.
During the message, Murray says, "I can't sleep now ... it's very hard ... I'm in constant pain ... can someone please help me please!?"
Ironic, since sleep trouble is why he's in jail in the first place -- only it was Michael Jackson who couldn't catch some zzzzs.
Murray says he's been crippled by a devastating shoulder injury -- "I can't use my hands anymore ... I have no more use of my arms."
The Doc says he's been calling everyone he knows for help -- but no one picked up.
Murray pleads to his friend to call Sheriff Baca for help -- "Ask him to please see me, maybe he don't know what happens in here."
FYI -- Murray is scheduled to be released by the end of the year, but Sheriff Baca could release him into home confinement before then ... if he feels like it.
"I can't sleep now ... it's very hard ... I'm in constant pain ... can someone please help me please!?"
Nothing wrong to use propofol to sleep according to Murray. So does he need a shipment? Anyone? Please.. he is begging to sleep.. hello.

The recommended elapsed time between a 400-mg dose of ibuprofen and a dose of aspirin depends on which is taken first. A 2005 study linked long-term (over three months) use of NSAIDs, including ibuprofen, with a 1.4 times increased risk of erectile dysfunction.[28][29] The study, conducted at Kaiser Permanente and published in the Journal of Urology, reported, "regular nonsteroidal anti-inflammatory drug use is associated with erectile dysfunction beyond what would be expected due to age and other conditions".[30] The director of research for Kaiser Permanente added, "There are many proven benefits of nonsteroidals in preventing heart disease and for other conditions. People shouldn't stop taking them based on this observational study. However, if a man is taking this class of drugs and has ED, it's worth a discussion with his doctor".[29] Overdose
Ibuprofen overdose has become common since it was licensed for OTC use. Many overdose experiences are reported in the medical literature, although the frequency of life-threatening complications from ibuprofen overdose is low.[31] Human response in cases of overdose ranges from absence of symptoms to fatal outcome despite intensive-care treatment. Most symptoms are an excess of the pharmacological action of ibuprofen, and include abdominal pain, nausea, vomiting, drowsiness, dizziness, headache, tinnitus, and nystagmus. Rarely, more severe symptoms, such as gastrointestinal bleeding, seizures, metabolic acidosis, hyperkalaemia, hypotension, bradycardia, tachycardia, atrial fibrillation, coma, hepatic dysfunction, acute renal failure, cyanosis, respiratory depression, and cardiac arrest have been reported.[32] The severity of symptoms varies with the ingested dose and the time elapsed; however, individual sensitivity also plays an important role. Generally, the symptoms observed with an overdose of ibuprofen are similar to the symptoms caused by overdoses of other NSAIDs.
Correlation between severity of symptoms and measured ibuprofen plasma levels is weak. Toxic effects are unlikely at doses below 100 mg/kg, but can be severe above 400 mg/kg (around 150 tablets of 200 mg units for an average man);[33] however, large doses do not indicate the clinical course is likely to be lethal.[34] A precise lethal dose is difficult to determine, as it may vary with age, weight, and concomitant diseases of the individual patient.
Therapy is largely symptomatic. In cases presenting early, gastric decontamination is recommended. This is achieved using activated charcoal; charcoal adsorbs the drug before it can enter the systemic circulation. Gastric lavage is now rarely used, but can be considered if the amount ingested is potentially life-threatening, and it can be performed within 60 minutes of ingestion. Emesis is not recommended.[35] The majority of ibuprofen ingestions produce only mild effects and the management of overdose is straightforward. Standard measures to maintain normal urine output should be instituted and renal function monitored.[33] Since ibuprofen has acidic properties and is also excreted in the urine, forced alkaline diuresis is theoretically beneficial. However, because ibuprofen is highly protein-bound in the blood, renal excretion of unchanged drug is minimal. Forced alkaline diuresis is, therefore, of limited benefit.[36] Symptomatic therapy for hypotension, gastrointestinal bleeding, acidosis, and renal toxicity may be indicated. On occasion, close monitoring in an intensive-care unit for several days is necessary. A patient who survives the acute intoxication usually experiences no late sequelae.
Ibuprofen is sometimes used for the treatment of acne, because of its anti-inflammatory properties,[53] and has been sold in Japan in topical form for adult acne.[54]
As with other NSAIDs, ibuprofen may be useful in the treatment of severe orthostatic hypotension (low blood pressure when standing up).[55]
In some studies, ibuprofen showed superior results compared to a placebo in the prophylaxis of Alzheimer's disease, when given in low doses over a long time.[56] Further studies are needed to confirm the results before ibuprofen can be recommended for this indication.
Ibuprofen has been associated with a lower risk of Parkinson's disease, and may delay or prevent it. Aspirin, other NSAIDs, and paracetamol (acetaminophen) had no effect on the risk for Parkinson's.[57] In March 2011, researchers at Harvard Medical School announced in Neurology that ibuprofen had a neuroprotective effect against the risk of developing Parkinson's disease.[58][59][60] People regularly consuming ibuprofen were reported to have a 38% lower risk of developing Parkinson's disease, but no such effect was found for other pain relievers, such as aspirin and paracetamol. Ok. His voicemails kind of reminds me of Michael calling about being in pain, couldn't sleep sort of.
Anyway, in the tape he says that he is injured from the frequent handcuffing and I was asking myself why does he need to be handcuffed so often.
His lawyers say that in every visit he is handcuffed, weird, but it might be. How many visitors he has during a day to be handcuffed so oftten?
Is he handcuffed when he gets out of his cell to have the meals 3 times a day?
Is he handcuffed when he gets out of his cell to got to the roof for exercises once a week?
Are the others inmates handcuffed that often as well?
If so LAPD jail would need a lot of handcuffs and a lot of officers to handcuff every single inmate at lunch time or dinner time
If he is having so good behavior and helping other inmates as was said before, how does he do that with handcuffs? and why does he has to be handcuffed to talk to his lawyers or visitors?
Too bad that we don't have how to know if this is the normal procedures at Central Jail, sounds odd.
Tom Mesereau -- the lawyer who successfully defended Michael Jackson in the singer's 2005 molestation trial -- literally could not stand to listen to Conrad Murray's desperate voicemail yesterday ... telling TMZ, "This man is despicable."
Tom was out in L.A. when we played the recording for him, and after just a minute, Tom turned it off with a disgusted look on his face ... saying, "I can't listen to any more of this."
Tom then tore into Conrad Murray over his desperate pleas for sympathy -- saying, "This man is despicable. This man has never taken responsibility for what he did to Michael Jackson. He's always been a blamer. He blames Michael Jackson for everything."
Tom added, "[Conrad] wants everyone to feel sorry for his situation. He caused the death of one of the greatest artists in world history ... a kind, decent, wonderful, nice person. He caused his death and he's never taken responsibility for it."
TMZ posted the voicemail recording yesterday morning, in which Murray pleads with a friend to save him from jail -- saying, "I can't sleep now ... it's very hard ... I'm in constant pain ... can someone please help me please!?"
TMZ cut part of the interview, too bad, but at one point Mesereau says he doesn't believe one word about what Murray says (I don't know if he is refering to the handcuffing) because Murray is a blamer he blamed Michael's "death" on Michael

LOS ANGELES (KABC) -- Michael Jackson's personal physician is still doing time for his role in the pop star's death. Dr. Conrad Murray's attempt to appeal his conviction, however, took a strange turn this week after a meeting with his lawyers got physical.
Valerie Wass, Murray's appellate lawyer, is working to have the doctor's involuntary manslaughter conviction overturned. But when she met with Murray at Men's Central Jail on Tuesday, she said she ran into Murray's former trial attorney, J. Mike Flanagan and his son, Ryan Flanagan, who were with Murray in a meeting room.
Wass said Ryan Flanagan physically pushed her out of the room.
"He actually pushed me out of the room," Wass said. "That person turned around and got up and shoved me out of the room. I recognized that it was Mike's son."
According to Wass, Ryan Flanagan had no reason to be in the room with Murray.
"Instead of Mike asking Ryan to step out and allow us to talk, Ryan was going crazy and so we got into a shouting match," Wass said.
Michael Flanagan and his son were unavailable for comment.
The Los Angeles County Sheriff's Department said Wass filed a report a few hours after the alleged clash.
"I would say that there was a verbal altercation and there was allegedly a battery - unwanted touching in the form perhaps of a shove, but that's allegedly - so we'll get to the bottom of and find out exactly what did or did not occur what this somewhat minor dispute," sheriff's spokesman Steve Whitmore said.
The alleged altercation between Murray's legal teams remains under investigation. The city attorney's office said it has not determined whether it plans to file charges until it receives a full report from the sheriff's department. If charges are filed, they would likely be charges of misdemeanor battery.
Murray has been behind bars since his conviction in 2011 of involuntary manslaughter. He could be released as early October.

An Arizona-based company recently filed a patent for high-tech futuristic handcuffs that are, in a word, terrifying. In addition to restraining prisoners, the cuffs can also deliver electric shocks and sedatives.
They're still in the patent phase right now, of course, but when they do exist on a full commercial scale, they could work manually at a guard's behest or they could be programmed to automatically activate when someone in cuffs starts to act up or steps outside of certain boundaries. Safety mechanisms could--hopefully will--be set to prevent a guard from doping or shocking prisoners to the point where they suffer from major side effects. Death, for example.
As for the drugs: They could include "an irritant, a medication, a sedative, a transdermal medication or transdermal enhancers such as dimethyl sulfoxide, a chemical restraint, a paralytic, a medication prescribed to the detainee, and combinations thereof."
If the cuffs move past the patent office and into commercial production, it'll be interesting to see what sort of rules and regulations come attached. From patent photos, it looks like the developers might already have a prototype, which means we might be seeing them sooner rather than later. Note to self: Avoid jail.

Doesn't the jail have surveillance cameras? Do they allow the visitors to be with inmate without any supervision?
If so someone could provide propofol for Murray's sleeping problems, since the doctor already knows how to use it.

We all remember how Michael talked about the injuries he had suffered after being handcuffed.
At the end of this vid....
Michael said he was manhandled very roughly and that his shoulder is dislocated and he cant move his arms all the way...
Murray says:

They have restrained some of history's most infamous killers, but Los Angeles County Sheriff Lee Baca has ordered his deputies to turn in more than a thousand pairs of handcuffs made by a 223-year-old British company because they may be hurting suspects' wrists.
"It appears the engineering may cause injuries," Baca said of the steel cuffs made by Hiatt & Co. Ltd. "That is not our intent or our policy."
Anyone in handcuffs who struggles can be injured, Baca said. He said it's his job to ensure, as much as possible, that doesn't happen.
"We want to use a cuff that reduces the risk of injury. These are a very solid design and effective cuff," Baca said, holding a set of the Hiatts. "But we cannot use a cuff that has the potential for inadvertent injuries."
The company reacted harshly to the news that Baca had ordered more than 7,000 deputies to turn in their cuffs.
"Hiatt handcuffs are used by government agencies throughout the world, and are known for their quality and reliability," said Dawn Thompson, president of Hiatt-Thompson, the handcuff manufacturer's North American distributor.
"To this date, we have received no handcuff complaint or problems brought to our attention from any employee at the Sheriff's Department," Thompson said. She said department officials have not responded to her efforts to contact them, "and therefore we consider the accusations that have been made totally unfounded and without merit."
The company's Web site says it supplies cuffs to the Army and to the New York City Police Department. The Los Angeles Police Department uses Smith & Wesson cuffs, according to a spokesman.
The Sheriff's Department watchdog, Mike Gennaco, head of the Office of Independent Review, recommended that the use of Hiatts be halted after a probe into a July 2001 complaint of excessive force.
Gennaco said Eduardo Mata, arrested in a Lancaster park, accused deputies of cuffing him too tightly.
Gennaco said officials found Mata's wrists had been cut to the point of bleeding as he moved around in the back of a patrol car. Mata was later convicted of possession of a weapon and served 68 days in jail.
Capt. Carl Deeley, the newly appointed head of the Lancaster station, then noticed that the Hiatt cuffs used in the incident had sharper inside edges than the Peerless and Smith & Wesson brands also used by deputies, Gennaco said.
"The Peerless have beveled edges; these don't," Gennaco said, handling the Hiatt Model 2010 nickel-plated cuffs.
Gennaco said he wants to make it clear that Hiatt handcuffs are not defective, and meet federal standards. He said there is no evidence to suggest others have suffered injuries. Lawsuits and claims over handcuffs are common, he said.
The Hiatt handcuffs, Gennaco said, were acquired between 1989 and 1994 from Hiatt-Thompson for $14.24 each. Approximately 1,975 pairs of handcuffs were purchased and more than 1,000 pairs remain in use.
Baca said there is a sufficient supply of Peerless and Smith & Wesson brands to replace the Hiatt cuffs, and the $20,000 it will cost to restock can be covered in the existing budget. Hiatts account for an estimated 7% of the handcuffs in circulation in the department.
Deputies early this month received a memo telling them to turn in their Hiatts by June 23.
"Why not do everything possible to reduce injuries?" Gennaco asked. "Injuries mean more deputy time on investigations, and increased medical costs."

Now it was in June 2003, Lee Baca asked his depties to get rid of the bad handcuffs and as we can see in the timeline, Michael was handcuffed in November 2003 and talked about the injuries (on 60 minutes) in late December 2003. Now I cant help wondering if the deputies were ordered to use the bad Hiatt handcuffs on Michael, five months after the were told to get rid of them... Interesting aint it?

"Michael was kept in a sedative state back then as well, says the writer. “At the time I was working with him, he was taking a lot of Ibuprofen. Which is just a regular drug store painkiller. It gave him a kind of a wooziness, he was always a little bit sleepy, a little bit happy. But I didn’t think then that it was a major problem. He always had quite a severe back pain. The problem with Ibuprofen (which people take for colds and flue) is that they are quite addictive and once you use it for even a week it can be a problem and he was taking them all the time. And we know now that he was taking a lot more painkillers then just that.”

First of all I have never seen anyone act like Nicole did in the witness stand so for that alone she should be getting job offers as an actress

Yes this part is interesting. It is old news but still worth to wonder once again as I have said before: why id no publisher interested? Because they love Michael so much? Because they dont want the person who "killed" him to speak? Since when did publishers care about anything else than sensationalism and seen other people's misery as anything less than a story, which sells well? There certainly are enough crappy books about Michael and they dont portray him nicely at all. So either its not true that no publisher want to publish the book or there is a whole other agenda. Ultimately as we know, Murray could damage AEG and those above AEG so a lot of people would be interested in not getting out the truth about the people, who wanted to get rid of Michael. is that why no publisher wants to deal with this book? Why arent the tabloids crowding eachother to get the exclusive on this one? Is it because Murray was the fall guy and the public MUST be convinced that its over and done with and no other people involved? Interesting it is indeed...

Yes and we are back to the Tell All book. No publisher wants to be part of Murray's book publishing so instead he calls people and one of them, coincidentally the poor unemployed actress sells the story to the tabloids. SO the tabloids love stories about Murray as long as he doesnt speak about AEG. Having someone record his message is an excellent way of getting "the message" out. How fortunate that Nicole didnt pick up the phone or she wouldnt have the chance to get it on tape and sell the message. Or was this really just a recorded message sent to her on purpose? Was it even on the phone? So many people he called .. to make sure that it wouldnt sound too coincidental that he only called Nicole and she happened to be not answering and she could bring his message to the media? What are the odds? You are a woman, whose boyfriend and the father of your child is in prison and you dont pick up the phone? What did she tell her kid? "Oh its dad. You must miss him but we will let the machine get it". And even if she wasnt at home, she has a cell phone. And you still dont pick up the phone when your boyfriend in jail calls. He has been complaining a lot so she should be anxious to hear news from him. Besides this handcuffing and the pain didnt happen over night and yet this is the first time he tells his girlfriend about it? Sounds a little out there in my humble opinion. But as I am leaning more to the possibility that there is actual a "message" in this message, we must congratulate the good doc for getting the message out there... that sheriff Baca and his deputies have a problems with handcuffs even though as I stated in an earlier post, there has been a lot of criticism earlier on. A lot of prisoners have complained of how they were treated by the police. Only a few months ago we had a story about a policeman literally playing Superman gone bad (who on earth goes to work as a policeman and wears a Superman shirt under the uniform?)

LAPD officer Tasered woman in handcuffs, records show November 18, 2012
Four Los Angeles police officers are under scrutiny after one Tasered a handcuffed woman while joking with others at the scene, according to interviews and law enforcement records.
The video taken of the December 2010 arrest shows Officer Jorge Santander firing the Taser without warning and later displaying a Superman logo he wore on his chest beneath his uniform, according to records. Off camera, another officer is heard laughing and singing.
Santander then appeared to lie about the incident repeatedly in written reports. The three other officers who witnessed him stun the woman corroborated his version of events when first questioned and failed to tell supervisors that a video of the encounter existed, records show.
According to a memo written by a prosecutor in the Los Angeles County district attorney's office, the incident began when two officers, Steven Bauman and Jose Lepe, were dispatched to a parking lot behind a Hollywood nightclub around 1:30 a.m. on Dec. 4, 2010, when a couple reported a drunk woman inside their car.
After the woman refused to leave voluntarily, records show, the officers arrested her on suspicion of public intoxication.
The officers requested a female officer be sent to assist, which is when Santander arrived with his partner, Georgeta Buruiana, who searched the woman, records showed. For reasons not explained in a D.A. memo of the event, Santander and Buruiana would transport the woman to a nearby station for booking.
Bauman had turned on a personal video camera and focused it on Santander and Buruiana as they led the woman over to their patrol car. She resisted getting in — something she had also done when Lepe tried to seat her in the back of his patrol car.
As before, officers shoved the woman into the seat, but she managed to stand back up. Without warning, Santander placed a Taser against the woman's torso and fired it twice, according to the prosecutor's account of the video. The woman fell face-down onto the seat.
Immediately after he delivered the shocks, Santander stated that the woman had kicked him in the stomach. It was not possible to tell from the video if the claim was true, the memo said. The D.A. memo details Santander displaying the Superman logo but does not say exactly when in the chronology it occurred.
As the woman lay in the car kicking and yelling, the video showed the officers discussing how to move her into a seated position. Santander climbed into the front seat and is heard warning the woman that she will be shocked again if she doesn't comply, the prosecutor wrote. The officer then reached back toward the woman with the Taser and, according to the memo, appeared to place it against her arm as the weapon's red activation light illuminated, although it was unclear if he pulled the Taser away before the electrical charge began.
When a sergeant arrived at the scene, Bauman turned off the camera. Santander told the supervisor simply that he had used the Taser on the woman twice because she had kicked him and had tried to kick out the windows of the patrol car. The three other officers corroborated that version of the encounter and none mentioned Bauman's video, the memo said.
Sometime later in the day, Santander wrote an account of firing his Taser for the woman's arrest report. In it he said he had fired the Taser only twice and warned the woman that she would be stunned before firing the Taser the first time. He also alleged that she had kicked him in the chest with such force that she knocked him off balance. Both claims — about the warning and being knocked off balance — were proven false by the video, the prosecutor wrote.
Santander amended the arrest report a few days later, saying that it had been Bauman, instead of himself, who warned the woman about the Taser. That, too, was untrue according to the video, the memo concluded. Santander also added mention of firing the Taser from the front seat but said he had used it only to scare her with the noise of the electrical charge.
Word of the video reached a supervisor only after Santander asked an officer if he had seen it and that officer reported the conversation to a higher-up.
The woman declined to speak to investigators about the incident on the advice of her attorney. The Times could not reach her for comment, and the officers involved did not respond to requests for comment.
Police officials confirmed that Police Chief Charlie Beck is seeking to have Santander and the three others fired. All four were suspended with pay until August this year, when the department concluded an internal investigation and Beck ordered each of them to go before discipline panels, which has the power to fire officers.
One officer's hearing is underway, and the others are expected in the coming months, Cmdr. Andrew Smith said.
The nearly two-year delay in passing judgment on the officers was a result, in part, of the seriousness of the case. Santander's actions were disturbing enough to police investigators that they postponed the internal inquiry in order to present the case to the district attorney's office for possible criminal charges.
The D.A.'s office concluded last year that the video and other evidence were not conclusive enough to prove that Santander had committed any crimes, according to the prosecutor's memo. Prosecutors also declined to charge the woman.
The incident marks the fourth time in the last few months that cases have come to light in which LAPD officers are accused of using force on suspects who had been restrained. The civilian Police Commission, which oversees the LAPD, has launched an independent inquiry into cases of Taser use and other types of non-lethal force by officers.
There are a lot of prisoners complaining of how they are treated and how handcuffs are used, but most of them seldom heard. Michael called attention to the problem when he was arrested...

The whole Murray handcuff thing may or may not have any connection to the hoax.. but we know that Michael is the expert in getting the message out and how he uses the media like they have always used him. Now about Tom Mesereau...
Tom Mesereau -- the lawyer who successfully defended Michael Jackson in the singer's 2005 molestation trial -- literally could not stand to listen to Conrad Murray's desperate voicemail yesterday ... telling TMZ, "This man is despicable."
Tom was out in L.A. when we played the recording for him, and after just a minute, Tom turned it off with a disgusted look on his face ... saying, "I can't listen to any more of this."
Tom then tore into Conrad Murray over his desperate pleas for sympathy -- saying, "This man is despicable. This man has never taken responsibility for what he did to Michael Jackson. He's always been a blamer. He blames Michael Jackson for everything."
Tom added, "[Conrad] wants everyone to feel sorry for his situation. He caused the death of one of the greatest artists in world history ... a kind, decent, wonderful, nice person. He caused his death and he's never taken responsibility for it."

It seems to me that Mesereau doesnt really knew what Murray was talking about and that wasnt easy cause TMZ just hands him the cell and he listens to the sobbing for less than a minute and doesnt hear exactly what Murray was complaining about. Mesereau is upset with Murray because Murray during the trial blamed Michael. But in this voice recording there is no blame put on Michael; in fact Murray talks about being maltreated by the police much like Michael did. Maybe if Mesereau had listened to the full voice mail and had time to think about it, he would have had a slightly different attitude. Not towards Murray but to the topic of the message.

There certainly are enough crappy books about Michael and they dont portray him nicely at all. So either its not true that no publisher want to publish the book or there is a whole other agenda. Ultimately as we know, Murray could damage AEG and those above AEG so a lot of people would be interested in not getting out the truth about the people, who wanted to get rid of Michael. is that why no publisher wants to deal with this book? Why arent the tabloids crowding eachother to get the exclusive on this one? Is it because Murray was the fall guy and the public MUST be convinced that its over and done with and no other people involved? Interesting it is indeed
The parallels goes here too, allegedly Michael wrote a book that no one wants to publish.
About Murray one thing is interesting. During the trial the judge asked to the prosecutors for the compensations, at this point, the Estate and the family could have asked for any money Murray could make from interviews, books or documentaries. The Estate and the family declined the resquest for any compensation. Murray only have to pay the fees for the trial.

Conrad Murray Dumped By Attorney Michael Flanagan Following Jailhouse Altercation With Legal Team
Just one week after Michael Flanagan got into a heated jailhouse altercation with Valerie Wass, his fellow attorney and co-counsel, he has announced his intention to no longer represent their client, Conrad Murray, RadarOnline.com is exclusively reporting.
“Flanagan will inform Murray during his next jailhouse visit that he will no longer be representing him,” a source tells Radar. “Michael had been representing Murray in his fight against the California Medical Board to get his medical license reinstated.
“Michael had been assisting Wass, who is Murray’s appellate attorney, but wasn’t formally on record. Michael has already formally notified Wass in writing that he’s quitting and will give Conrad referrals for other attorneys who may be able to assist him.”
The two attorneys, along with Flanagan’s son, were involved in a physical and verbal altercation at the Men’s Central Jail in Los Angeles last week as they were visiting Murray. Wass subsequently filed a police report alleging Flanagan’s son pushed her. A Los Angeles County Sheriff’s Spokesperson said it was a “very minor altercation” but that there would be an investigation in to the matter.

Restraining order issued between Conrad Murray attorneys after jailhouse, doughnut shop altercations
PASADENA - An attorney who ended his representation of Dr. Conrad Murray after a heated jailhouse altercation with his co-counsel has obtained a temporary restraining order against the woman, alleging she threw hot water at him at a doughnut shop.
Last Thursday, Pasadena Superior Court Judge Terry Smerling directed Valerie Wass not to come within 200 yards of Michael Flanagan, his business and his car. She also was directed not to harass or intimidate him.
A hearing on whether to extend the order is scheduled April 3.
Flanagan had been assisting Wass, who is working as Murray’s appellate attorney, seeking to overturn his November 2011 involuntary manslaughter conviction in the June 2009 death of pop star Michael Jackson.
The two attorneys, along with Flanagan’s son, were involved in a physical and verbal altercation at the Los Angeles County Men’s Jail in Los Angeles in January as they were visiting Murray, where the doctor is serving a four-year sentence.
Wass filed a police report alleging Flanagan’s son pushed her, according to media reports.
According to court papers filed by Flanagan’s lawyer, Charles Unger, Wass confronted Flanagan on March 8 at a Winchell’s doughnut shop on Lake Avenue.
“Miss Wass came into Winchell’s … yelling gross profanities and threw a scalding hot container of coffee at my face and torso,” Flanagan stated in his court papers. “I was slightly burned by the coffee and also incurred property damage to clothing.”
Wass told a reporter afterward that she “should have shot me,” Flanagan’s court papers state.
Wass also has “stalked” Flanagan other times at Winchell’s, at Crispy’s Deli in Glendale and at the jail, Flanagan’s court papers state. She also has been “relentless with obscene emails to my office,” Flanagan’s court papers state.
Flanagan alleges the situation has gotten worse over time.
“In each of these incidents she used physical force and extreme profanity,” Flanagan states. “Each incident is getting progressively more violent.”
Are they trying to postpone the filing of Murray's appeal again, with all this fight?

Conrad Murray defends lawyer as appeal nears
Los Angeles (CNN) -- Dr. Conrad Murray defended his appellate lawyer from "a slew of disparaging remarks" just days before she files the appeal of the doctor's involuntary manslaughter conviction in Michael Jackson's death.
CNN has obtained sections of that 300-page appeal, including the defense argument that the trial judge erred by not allowing the testimony of Dr. Arnold Klein, a dermatologist the defense contended addicted Jackson to Demerol in his last weeks.
Murray's appeal, which will be filed Monday, also argues that prosecutors never proved Jackson was hooked up to an IV drip of the drug that killed him. The defense theory was that Jackson had administered the fatal dosage himself while the doctor was away.
The coroner ruled that Jackson died from an overdose of the surgical anesthetic propofol in combination with sedatives on June 25, 2009. Murray told investigators he used propofol to induce sleep because Jackson was suffering from insomnia.
Murray served as Jackson's personal physician as the pop icon prepared for 50 shows that were to debut in London in July 2009, but his patient was fighting a battle for sleep between rehearsals.
A wrongful death lawsuit filed by Jackson's three children and his mother is set for trial next month. The family accuses concert promoter AEG Live of liability in his death by hiring and supervising the doctor, who was convicted of involuntary manslaughter in November 2011.
Murray takes a side in lawyer dispute
Murray -- during a phone call to CNN Saturday from the Los Angeles County jail where he's been held since he was sentenced to four years in prison -- said he was "impelled to stand up for" attorney Valerie Wass, who has been involved in a personal dispute with Murray's trial lawyer Michael Flanagan.
Flanagan was helping Wass, who wrote the appeal, until the two lawyers were involved in a jailhouse argument last January. Flanagan dropped Murray as a client after the incident, but the appeals court later ordered him to respond to requests from Wass for case files, which she said he had withheld.
Murray, who witnessed the January incident between his attorneys, issued a strong statement of support for Wass in his call from jail.
"In recent weeks, I became keenly aware that a slew of disparaging remarks and personal information about my appellate attorney, Valerie Wass, were unjustly released to the media and the public," Murray said. "Because of this injustice, I am impelled to stand up for this woman, for whom I have the utmost respect and confidence."
Wass completed work on the appeal even though "with the blink of an eye, all of her promised assistance vanished; they abandoned ship," Murray said.
A call to Flanagan for comment was not immediately returned.
"Although she needed help, she did not quit, did not jump ship, nor did she succumb to pressure while others abdicated their responsibilities," he said. "She held steadfastly to her professional and moral conduct, which was bolstered by her amazing mettle of mind and spirit."
Murray said Wass "stood up for me amidst a most arduous and challenging series of obstacles, and whose loyalty remains indisputable. It is my belief that she took a personal hit for me, and I want to let her know that I'll forever be grateful."
Murray's appeal: Jackson's Demerol addiction
Although Murray could be freed in about seven months, he is seeking to clear his name and get his medical license back by having his conviction overturned on appeal.
The appeal contends that Los Angeles Superior Judge Michael Pastor wrongly prevented Murray's trial lawyers from making their case that Jackson was going through withdrawal from a Demerol addiction the day he died.
"The reason it sought to prove that Jackson was going through Demerol withdrawal on June 25th was to show his state of mind -- specifically, that his resulting physiological and psychological state, along with the pressure he was under from preparing for the upcoming tour, rendered him so desperate for sleep that he would take the extraordinary action of self-administering propofol when he was outside the presence of appellant," Wass writes.
Defense experts testified at the trial that Jackson's insomnia could have been caused by the withdrawal.
The defense wanted Klein and two staff members to testify about Jackson's 23 visits to their Beverly Hills clinic in the three months before his death, including five in June 2009. Jackson was given Demerol during those visits, the last time on June 22, three days before he died.
"Michael Jackson could not sleep because of the Demerol," the defense said in pretrial arguments. "Dr. Murray did not know that. But Arnold Klein did. Michael Jackson needed sleep because he was withdrawing and addicted, both addicted and withdrawing from Demerol. That's important to our defense. In fact, it's absolutely vital."
Pastor, however, ruled that testimony from Klein and his staff would be a "distraction and divergence" in the trial.
"The defense was also unable to prove whether Jackson was addicted to Demerol and going through withdrawal at the time he died, because experts in the case articulated they could not reach conclusions based only on reviewing Klein's records," Wass writes in the appeal.
If Klein or his staff had been allowed to testify at the trial, "It is reasonably probable that at least one juror on the panel would have found appellant not guilty of involuntary manslaughter," the appeal argues. "Accordingly, regardless of the applicable standard of review, appellant's conviction must be reversed."
Murray's appeal: No proof of IV drip
The prosecution's theory in the trial was that Murray hooked Jackson up to an unusual makeshift IV drip of propofol and then left him alone to make phone calls in an adjacent room. Murray was criminally negligent because he did not properly monitor his patient who later died from an overdose, they argued.
The defense argued that the IV drip only sent saline into Jackson's leg to hydrate him and that Murray used a syringe to slowly push a safe dose of propofol into Jackson's blood while he watched him fall asleep. A frustrated Jackson could have awakened while Murray was away and administered the fatal dose himself, the defense said.
"The propofol infusion theory offered by the prosecution's expert was not supported by the evidence, and in fact, was so absurd, improbable and unbelievable that a rational trier of fact could not have concluded that the evidence was sufficient to establish that appellant had placed Jackson on a propofol drip on the day of his death," the appeal argues.
The prosecution built the IV drip theory based on testimony of one of Jackson's guards who said he saw a propofol bottle hanging above Jackson's death bed when he arrived to help revive him. An investigator also found a saline bag with a slit in it, which the prosecution contended was used to hold the bottle on the IV stand.
Defense propofol expert Dr. Paul White testified such an IV drip set up was "befuddling" because a propofol bottle comes with a hanging device. The hanging tab on the bottle was not used, both sides agreed.
"The prosecution concocted the novel and ridiculous method of placing the vial into the bag through the slit, hanging the bottle upside down at an angle using the bag for support, and then hanging the bag from the IV stand," the appeal argues.
A piece of tubing key to the IV drip was never found, but the prosecution suggested Murray could have slipped it into a pocket before leaving the bedroom to ride to the hospital with Jackson.
Wass argues that is "pure speculation, and the absence of evidence of a long IV line with propofol residue is fatal to the prosecution's theory."
"If an IV line used in a propofol infusion had been placed in appellant's pocket, it would have been dripping propofol, and resulted in a messy wet pocket," the appeal argues. "Such a result is not reflected in any photograph, testimony, or statement of any witness."
Murray's appeal: Jackson gave himself fatal dose
Michael Jackson got little sleep the morning he died, despite Murray's bedside efforts using sedatives, according to Murray.
"It is likely that Jackson's heightened insomnia on June 25th was exacerbated by his surreptitious Demerol addiction and the resultant acute withdrawal syndrome therefrom," the appeal says. "Jackson's last Demerol injection was on June 22nd, less than 72 hours before his death, which could have been a peak period for the occurrence of withdrawal symptoms."
But he did fall asleep at 10:40 a.m after a single dose of propofol, he told investigators. After watching him for 15 minutes, Murray left him alone, the appeal says.
"The evidence is consistent with a scenario in which Jackson quickly self-injected the lethal bolus dose of propofol while appellant was outside the bedroom," the appeal contends. "Based on the toxicology results, it appears that the rapid injection lead to cardiac arrest and a quick death."
He may have had access to a bottle of propofol without Murray knowing, the appeal says.
"Jackson was very familiar with propofol, as other doctors had administered propofol to him," Wass writes. "It is conceivable that Jackson had obtained a secondary source for the drug, especially because Jackson had been receiving nightly infusions from appellant for the previous two months, and appellant had Sunday nights off."
If Jackson -- not Murray -- administered the final and fatal dose, then it was not the doctor's fault the patient died, the argument says.
Murray's appeal disputes the prosecution argument that Murray was criminally liable even if Jackson had administered the fatal dose himself because Murray should have known that leaving the drugs near Jackson's bed posed a risk. The risk was "not reasonably foreseeable," it said.
The prosecution will have a chance to respond to Murray's arguments before the California appeals court makes a decision.

Conrad Murray's lawyer asks appeals panel to throw out conviction The attorney contends that prosecutors had failed to prove that the cardiologist was responsible for Michael Jackson's 2009 death and that the judge 'displayed bias' against Murray.
Dr. Conrad Murray's trial was "fundamentally unfair" because of the publicity surrounding his manslaughter case and the fame of his patient, Michael Jackson, the physician's attorney wrote in papers filed Monday asking an appellate court to throw out his conviction.
Murray's attorney contended that prosecutors had failed at trial to prove that the cardiologist was responsible for the pop icon's death. She also contended that the trial judge, Michael Pastor, "displayed a bias" against the doctor.
Murray was sentenced to a maximum four-year sentence after his 2011 conviction for involuntary manslaughter.
The appellate attorney, Valerie Wass, argued in her 231-page brief that Jackson probably injected himself with the surgical anesthetic that led to his death and that the judge should have allowed Murray's defense to present evidence of the pop star's dire finances.
"In more ways than one, Jackson was a desperate man," she wrote. "Based on his desperate financial state, combined with his physiological problems, Jackson may have acted recklessly and/or irrationally on June 25th by self-injecting."
In trial, prosecutors responded to the theory by arguing that even if Jackson had awoken and given himself the fatal dose, Murray was still negligent and should be held responsible for the singer's death.
Wass also wrote that jurors could not possibly have been shielded from the overwhelming media coverage of the seven-week trial. She noted that witnesses gave media interviews during trial and that there was even a "Michael Jackson Doctor Trial" smartphone application.
She accused Pastor of sentencing Murray to a harsher term than he deserved because the case was high-profile.
"It appears that due to the publicity surrounding the case, and the fact the victim was one of the most famous people in the world, the court was trying to make an example out of appellant," she wrote.
Before handing down Murray's sentence, Pastor remarked from the bench on Murray's lack of remorse in a television interview that aired after the trial.
"Talk about blaming the victim.... Not only isn't there any remorse, there is umbrage and outrage on the part of Dr. Murray against the decedent," the judge said at the time.
Wass contended that it was improper for Pastor to consider media interviews.
Murray is due to be released in October under state sentencing guidelines. The outcome of the doctor's appeal would affect his ability to practice medicine following his release.
Dr. Conrad Murray is once again speaking out from jail (but not singing this time) -- still proclaiming his innocence in the death of Michael Jackson ... and says he has hopes of practicing medicine again some day.
Murray called in to the "Today" show this morning live from jail and said he is sorry that Jackson died, but he still maintains he is in no way responsible for his death. Murray is sticking to his story ... that Jackson administered the fatal dose of propofol himself.
The good doctor also said he DIDN'T file his appeal to shorten his prison sentence, but rather so that he can one day restore his medical license and see patients again.
