A Celebrity Home That's Not on the Star Maps

There is no question as to which is the most exclusive penthouse apartment in the City of Angels.

Among the amenities are soaps, conditioners, razors. A continental breakfast is offered; a picnic-style lunch and a warm beefsteak dinner. The pillows are feather, the complimentary slippers are canvas, the bed garments orange. There is a library and plenty of solitude. The suite occupies a corner lot, the view is unique and security is among the best in town. The bellhops dress in green and wear white gloves.

All this at the reasonable rate of $53.45 a night. But leave your wallet at the front desk. Your money is no good here; taxpayers pick up the tab.

Do not bother to call for reservations for Room 7021, for none are accepted. It is the domicile reserved wholly for men whose reputations are drifting from famous to infamous, and for a smaller circle of men whose actions are said to be so heinous even bad men despise them.

This is the Los Angeles County Jail protective custody unit. The cellblock that includes Room 7021 is known as the Hospital, as it was formerly the infirmary. Room 7021 has no name, though some officers have christened it The Heisman, after O. J. Simpson spent the better part of a year there while on trial in the murder of his former wife Nicole and her friend Ronald L. Goldman.

The guest list at Room 7021 has been an extensive one, its guardians say. Robert Blake, better known as the 1970's TV detective ''Baretta,'' now resides there, awaiting trial on murder charges stemming from the death of his wife, Bonny Lee Bakely. On Wednesday, the California Supreme Court denied bail to Mr. Blake, 69, until a preliminary hearing in the case next month.

Robert Downey Jr., once nominated for an Academy Award, has also spent time in Room 7021. In 1997, Mr. Downey was sentenced to 180 days in jail for repeated parole violations of a prior drug conviction.

At first, Mr. Downey was placed in the general prison population. But then he appeared in court looking like a raccoon, his forehead split open by an overzealous inmate. For his own protection and the sustained tranquillity at the Men's Central Jail, he was upgraded to Room 7021.

''This is not a hotel and we don't give celebrities special treatment,'' said Capt. Richard Adams, the man in charge of the 7,200-inmate jail, the largest under one roof in the country.

Adams defended segregating high-profile prisoners, saying, “The guys in here will prey on them and eat them alive, so off to protective custody they go. I don’t want anyone getting hurt in here.” Of course by that he really means he doesn’t want anyone famous or rich getting hurt at the jail – since non-celebrity prisoners are regular victims of violence and sometimes-fatal medical neglect.

In fact, in a six-month period from October 2003 to April 2004, five prisoners were murdered in the Los Angeles County jail system.

Michael Jackson's doctor too poor to fund appeal

(Reuters) - Michael Jackson's doctor on Tuesday asked for a publicly-funded lawyer to handle his appeal on a manslaughter conviction in the pop star's death, saying he could not afford to pay for one himself.

Dr. Conrad Murray, serving a four-year jail term for the involuntary manslaughter of Jackson in 2009, filed papers with Los Angeles Superior Court saying he was unable to fund his legal help any longer.

"The defendant is indigent and respectfully requests the appointment of counsel on appeal," the court papers said.

Murray said he wished to appeal both his conviction and his sentence but so far has not filed formal papers with the California appeals court.

Lawyer says Jackson doctor under tight security

LOS ANGELES (AP) — The doctor convicted of killing Michael Jackson is coping with tight security and isolation and remains optimistic that he will win an upcoming appeal, his civil attorney said Tuesday.

Charles Peckham said sheriff's deputies appear to be subjecting Conrad Murray to more security than other inmates at Men's Central Jail and that the physician was left heavily shackled during their jailhouse meeting.

"Treating him like Hannibal Lecter is offensive," Peckham said, referring to the fictional serial killer from popular books and films. A sheriff's officials defended the security measures, saying they were for Murray's safety.

The attorney had to obtain a court order Tuesday to meet with Murray to discuss strategy on a wrongful death lawsuit filed by Jackson's father. Peckham said despite the judge's order, he was denied entry to the jail, but officials relented after speaking with the civil trial court handling the case.

He said their initial 30-minute meeting was cut short when the jail was placed in lockdown, but Peckham said the time was enough to upset him and see that Murray's fortunes had dramatically changed.

"This man who saved lives made a mistake, and they're going to make him pay like a mass-murderer," Peckham said. The doctor spoke extensively to documentary filmmakers before his conviction, but few details of his life behind bars have been divulged.

Murray "is a real target because of his notoriety and because of the Michael Jackson connection," sheriff's spokesman Steve Whitmore said. "We're just being extra cautious right now."

He said jail officials will evaluate how to handle Murray's incarceration, but that he may not serve his whole sentence in isolation from other inmates. He noted that without a recent change in state law, Murray would be serving his term in state prison, not a county lockup.

Peckham said Murray, who has been jailed since a jury convicted him of involuntary manslaughter on Nov. 7, is optimistic that an appellate court will grant an appeal on the case.

Peckham's visit came hours after the physician, who was never paid the $150,000 a month he expected for serving as Jackson's personal physician, asked a court to provide a publicly funded attorney to handle his appeal because he is indigent.

J. Michael Flanagan, who was one of Murray's criminal defense lawyers, agreed with Peckham's description. He said that when he visited Murray recently, four deputies escorted the physician into the meeting room and shackled him to a table.

"He can't even scratch his nose," the attorney said. Flanagan said he saw another inmate who was charged with murder meet with his attorney without the same restrictive measures.

"This is because of his notoriety," Whitmore said. "It's not so much the crime itself."

Peckham said he didn't "think the sheriff's department is being anything but professional. I do however believe the amount of security for Dr. Murray is vastly out of proportion with the potential threat."

He said Murray told him he appreciates the support and prayers he's received from former patients and friends.

In the early days of his confinement, Murray was classified as suicidal in jail records, according to a probation report. Peckham said he saw no indications that the physician intended to take his own life and that he seemed to be in control of his mental health.

Murray indicated in a two-page court filing Tuesday that he would rely on a court-funded attorney to help craft his appeal. The U.S. Supreme Court has ruled that felony convicts have a constitutional right to assistance of counsel.

Flanagan and Murray's other criminal attorneys had sought to present evidence to jurors about Jackson's finances, details of his deal for a series of comeback concerts, and information about other doctors treating the pop superstar. But the judge refused and ruled the trial would be about Murray's care of the singer.

The Houston-based doctor had been giving Jackson nightly doses of the powerful anesthetic propofol as a sleep aid. The drug is normally given in hospital settings with extensive monitoring equipment, but testimony showed Murray had only basic equipment and left Jackson's bedside on the morning of his death.

Pastor has scheduled a hearing for Jan. 23 to decide whether to order Murray to pay any restitution to Jackson's family or reimburse them for funeral expenses, which totaled more than $1.8 million.

Jackson's estate estimated the singer would have earned at least $100 million if he had performed his "This Is It" concerts planned for London's O2 arena.

Murray will lose his medical license as a result of the conviction is upheld.


Again this makes very little sense. The cash-strapped Conrad Murray, who has asked for a court-appointed attorney for his appeal process, doesn't seem to be experiencing jail time like some other well-known names.

Murray's previous attorney J. Michael Flanagan is outraged at the doctor's treatment in the slammer, telling E! News that "it is crazy and unbelievable how [the sheriffs] are treating" Murray in jail.

Flanagan says that after waiting for over an hour to visit the doctor yesterday, Murray arrived with his feet and hands cuffed, and was then handcuffed to the table for their meeting. "I've never seen something like this before," for someone serving for this particular crime, the attorney tells us.

He also adds that Murray's cell is next to a member that is in jail for gang murder.

According to documents obtained by E! News, in the notice of appeal Murray filed this morning in Los Angeles Superior Court, Michale Jackson's former doc stated that he is "indigent and respectfully requests the appointment of counsel on appeal."

Murray was convicted last month of involuntary manslaughter in the 2009 death of Michael Jackson and was ordered to serve four years in a Los Angeles county jail. He intends to appeal his conviction, but does not have an attorney to work with to argue his case.

Flanagan tells E! News that he doesn't handle appeals and that is why he isn't representing Murray in this process. He says he has offered advice about whom Murray should have represent him, but says, "Whoever does it has a big undertaking" with all the evidence involved.

Murray had filed a motion to appeal back on December 6 "In Pro Per," which means he was planning to represent himself.

It does not make sense at all. First about his notoriety, his notoriety if there is any is only because of Michael Jackson, but it seems from the article that Michael Jackson connection is a second factor to Murray notoriety.

Are all the inmates Michael Jackson fans?

Murray walked around for 2 years, New York, Florida, LA, giving handshakes on the streets (remember the guy at New York?), going to a concerts, amusement parks, to the beach without any problems and now is dangerous for him?

Now TMZ article makes a little sense, when TMZ said that it wasn't sure that Murray's mother and Nicole were going to visit him and maybe the Visitor Status N on the records means "no visit without previous notice"... hahahaha

It makes me wonder, if Murray is really there. I mean you have to say in advance that you are going there to give them time to prepare Murray for visiting.

This is crazy.

Upset French fans sue Michael Jackson doctor

RENNES - French fans of Michael Jackson are suing the late pop star's doctor for "emotional damage" they suffered over his death, their lawyer said Friday.

The case against Conrad Murray, who was jailed in November over the star's 2009 death, is due to be heard in the city of Orleans on April 11, lawyer Emmanuel Ludot said.

"It's similar to losing a childhood friend in a traffic accident. Because this death affects you, you have the possibility to file a suit and seek compensation," Ludot said.

The lawyer is acting for around 100 fans who are members of an association that calls itself the "Michael Jackson Community".

He said that while each fan could be awarded damages of up to 10,000 euros (S$16,556), they were seeking only a symbolic euro.

Dr. Conrad Murray is asking the judge in his criminal case to deny Michael Jackson's family full restitution, on grounds MJ caused his own death.

Murray filed legal docs yesterday -- obtained by TMZ -- asking for evidence the defense never received during the trial ... evidence that could show Michael self-administered the fatal dose of Propofol.

Murray's lawyer, Michael Flanagan, argues that in deciding how much restitution the family gets, it's appropriate to consider the victim's responsibility for his own demise.

So Murray will concede he's partly to blame -- he can't argue otherwise because of the conviction -- but he still wants to prove that MJ ultimately caused his own death.

The prosecution is asking for around $100 million in restitution, but the judge hasn't decided on a figure. But once the figure is set, if Flanagan gets his way and the judge were to decide MJ was 50% responsible for his death, the judge would reduce the restitution award by 50%.

So the fat lady hasn't sung ... yet.

Conrad Murray will return to court to try to show that Michael Jackson is at least partly responsible for is own death.

He wants the judge to reduce the amount if restitution he must pay to Michael Jackson’s family. The doctor has already been found guilty of involuntary manslaughter so he cannot deny his own involvement. The only way for him to reduce the amount he must pay in restitution is by showing that Michael Jackson is also at least partly responsible for his own death.

Murray filed legal documents yesterday asking for evidence the defense never received during the trial. He says that it is evidence that could show Michael self-administered the fatal dose of Propofol.

Murray’s lawyer, Michael Flanagan, argues that in deciding how much restitution the family should be paid, the victim’s responsibility for his own death is an important factor.

So Murray will have to concede he is partly to blame. His conviction for involuntary manslaughter means he can’t avoid that, but he still wants to prove that Michael Jackson ultimately caused his own death.

Conrad Murray wants to prove Michael Jackson partly caused his death

Conrad Murray is allegedly hoping to prove that Michael Jackson was partly responsible for his death in order to deny the star's family millions of dollars in restitution.

The former physician was sentenced to four years in jail last November after being found guilty of the 'Billie Jean' singer's involuntary manslaughter.

Murray, currently serving his sentence at the Los Angeles County Jail, is believed to have filed legal documents yesterday (January 9) asking that evidence omitted from the trial be taken into consideration when deciding how much money he will give the Jackson family.

If this proves that Michael administered the fatal dose of propofol himself in June 2009, relatives will see their payment halved due to the shared responsibility of his death, TMZ reports.

Jackson Family Going After Dr. Murray's Money ... IS POINTLESS!!!

Prosecutors will no longer seek more than $100 million in restitution from Dr. Conrad Murray at the request of Michael Jackson's family, because as the proverb goes ....you can't squeeze blood from a turnip.

A rep for the Los Angeles District Attorney's Office says prosecutors were informed that the Jackson family is giving up on restitution ... so the D.A. withdrew the request. As a result, the restitution hearing scheduled for Monday has been called off.

Murray -- who's serving a 4 year jail sentence for his role in the death of MJ -- is basically broke ... and now that his medical license has been revoked, it's unclear how he plans to earn money once he's released.

It seems the Jackson family finally decided it wasn't worth the time or the energy to battle for scraps.

LOS ANGELES — Prosecutors will not seek restitution against the doctor convicted of killing Michael Jackson after conferring with the singer’s parents and attorneys for his estate and children.

The request for payments from Conrad Murray was withdrawn Wednesday during a brief court hearing, just days before a judge was scheduled to consider how much the former cardiologist should pay to members of Jackson’s family or his estate.
Deputy District Attorney David Walgren told the judge handling the case that he was withdrawing the restitution request after speaking with Jackson’s mother, Katherine, and attorney for his father, Joseph. Walgren also consulted with an attorney for the singer’s estate and a court-appointed attorney representing the interests of Jackson’s three children, a transcript of the proceedings shows.

Murray remains in jail after being convicted in November of involuntary manslaughter. He was sentenced to serve four years in jail, but his incarceration will be cut in half due to overcrowding and California’s budget crunch.

Jackson’s estate estimated the singer would have earned at least $100 million if he had performed his “This Is It” concerts planned for London’s O2 arena. Murray might have also been found liable for Jackson’s funeral expenses, which totaled more than $1.8 million. Murray’s attorneys said he had nowhere near the money to pay either amount, and he filed paperwork last month indicating he is indigent.

Joseph Jackson is suing AEG Live, alleging negligence by the entertainment promoter in his son’s death, and he is suing Murray for wrongful death in the case.

Murray’s attorney, J. Michael Flanagan, said he was pleased to have the restitution issue resolved. Flanagan said during Wednesday’s hearing that he intends to seek bail for Murray while he appeals his conviction, according to the transcript, but he was told to put the request in writing.
The fate of Joseph Jackson’s civil case remains unclear. A California bar court in Los Angeles recommended Friday that the Jackson family patriarch’s attorney, Brian Oxman, be barred from practicing law because of conduct on other, unrelated cases. Oxman filed Joseph Jackson’s lawsuit in federal court on the one-year anniversary of the singer’s death, but a judge later ruled it should be heard in state court. Oxman is the only attorney who has been listed on the case so far and has been a vocal antagonist against Murray and AEG Live.

Reached by phone, Oxman declined to comment on the recommendation, which still must be approved by the California Supreme Court.

The disciplinary court found that Oxman and his wife, who is also his law partner, mixed clients’ and personal funds in an effort to evade creditors and sanctions imposed against Oxman. He had been disciplined previously, which the court cited among its reasons for seeking the revocation of his law license.



Well, well, well... The demand for restitution rests. No money to be paid for the loss of a man, who is still alive. It kinda makes sense. No financial benefit from faking ones death.

At the same time the lawsuit against AEG continues. Going after the real bad guys, who really wanted Michael dead.

At the same time Joes lawsuit against Murray seems to be a bit uncertain due to Oxman's problems; couldnt Joe just get another attorney? Why would the case depend on what Oxman did in an entirely other case? Again if this lawsuit falls through we are back to the lawsuit against AEG and the 100 DOES.

What is weird here is Joe case. The first time, as I posted before, Joe didn't ask for restituition. There was no manifestation about this from Joe or his lawyer and still Joe is suing Murray asking for 500 million..

I think Joe may get another attorney. I don't know why he keeps Oxman around.

Well, the children have 2 lawyers and one social worker, working with them. One "lawyer" was hired by "Katherine" to look after the children business. This lawyer is different from Katherine lawyer, I don't remember their names, I believe they are 2 lawyers.
Another lawyer and a social worker was assinged by the judge to look after the interested of the children regarding the will, MJ estate and their guardian. The lawyer is a woman.
.
Any decision made by MJ estate has to be approved by this lawyer and justified to the judge. All the business, bills or anything made by the executors has to go through this lawyer analysis.
Also the way the Katherine is taking care of the children goes through this lawyer and social worker analysis

Well we dont have it from direct source but apparently Walgren asked Katherine and Joe and the representative for the children. Most of the articles we have seen (and posted on the forum) have spoken of "The Jackson family) and yet we know that they disagree about certain things, like for instance the reunion concert. Apparently Walgren gave no real reason for why Katherine and Joe gave up on the claim. Joe is still suing Murray for wrongful death but I still dont believe this has to do about the money. The legal terms are complicated.

The law of restitution is the law of gains-based recovery. It is to be contrasted with the law of compensation, which is the law of loss-based recovery. Obligations to make restitution and obligations to pay compensation are each a type of legal response to events in the real world. When a court orders restitution it orders the defendant to give up his gains to the claimant. When a court orders compensation it orders the defendant to compensate the claimant for his or her loss.

...meaning that if the family had asked for "compensation" it would be to cover the loss of the family member (like what Jos is suing Murray for or like the group of French fans)

But since the legal term is restitution it would ask for Murray to give up his gains (like profit from the interviews and salary I, if he had received any).

It also means that Murray no longer has an "excuse" but now he can talk to the media and do "Part two" (and of course he here has the chance to speak about AEG)

This type of damages restores the benefit conferred to the non-breaching party (the plaintiff). Simply, the plaintiff will get the value of whatever was conferred to the defendant when there was a contract. There are two general limits to recovery, which is that a complete breach of contract is needed, and the damages will be capped at the contract price if the restitution damages exceed it.

The orthodox view suggests that there is only one principle on which the law of restitution is dependent, namely the principle of unjust enrichment.However, the view that restitution, like other legal responses, can be triggered by any one of a variety of causative events is increasingly prevalent. These are events in the real world which trigger a legal response. It is beyond doubt that unjust enrichment and wrongs can trigger an obligation to make restitution. Certain commentators propose that there is a third basis for restitution, namely the vindication of property rights with which the defendant has interfered.It is arguable that other types of causative event can also trigger an obligation to make restitution.


So its two different things. What Joe is suing Murray for is "compensation", not "restitution" (Im not sure the media knows the differerence).

In the thread we have about Joe's lawsuit it says

Joe Jackson may have just dug himself a hole to China during a TV appearance in Brazil ... by telling the host Michael Jackson "never supported me."

During the interview on "Hoje em Dia," the interviewer incorrectly said, "According to TMZ, you were being supported by Michael." Joe responded, "No, he never supported me."

The statement flies in the face of his claim in the Michael Jackson Estate case ... that Michael did indeed support him -- which is why Joe asked for an allowance.

Even more serious for Joe, by admitting MJ never supported him, it could severely compromise his wrongful death lawsuit against Dr. Conrad Murray. Joe's statement could severely limit his monetary claim, because now he can't show he lost money when Michael died.

TMZ previously reported, Michael didn't support his dad, but he gave Katherine $50,000 - $66,000 a month ... and she would then use that money to pay for Joe's living expenses.
The statement flies in the face of his claim in the Michael Jackson Estate case ... that Michael did indeed support him -- which is why Joe asked for an allowance.


Joe's lawsuit is depending on whether he was financially supported by Michael prior to June 09. The lawyers for Murray had responded to the lawsuit as follows:

Lawyers for Dr. Murray filed the legal documents last Friday, arguing that Joe Jackson doesn’t have legal standing to even file the lawsuit — Michael left his father, Joe out of his will and did not support him financially.

The legal documents state: “Joe Jackson further has no standing to sue pursuant to…in that he was not dependent upon the decedent for support and therefore Joe Jackson has no subject matter jurisdiction, alternatively, in personam jurisdiction to sue….Defendants request that the Plaintiff’s case be dismissed, alternatively, that the Plaintiff go forth without recovery from these Defendants.”


So in fact we had three things going on:

1. Joes lawsuit for loss of financial support from his son (which of course also links to AEG indirectly as they may argue that Michael's means of income were unsufficient (his alleged huge debt prior to June 2009) had he not embarked on the project of TII (saying that Michael could only support Joe IF Michael did the concerts). Joe's lawyers could argue that not only Murray but also AEG is responsible and that the tour (AEG) destroyed the means of income rather than create more.

2. Katherine's direct lawsuit against AEG which has very little to do with Murray (he was merely the instrument or "AEG-hired help"). This is the interesting lawsuit as it points to the real culprits (and people behind AEG and behind Philip Anschutz).

Joe is also indirectly mentioned in this lawsuit (official documents).

This lawsuit is focused on the guilt and people responsible more than money.

3. The restitution claim which has now been dropped... and Murray can talk again because noone is asking for any profits of gain (remember it was a rather big issue at the trial... what the different staff members gained from their interviews with the media)

Doctor convicted in Michael Jackson’s death seeks release from jail pending appeal

LOS ANGELES — The doctor convicted of involuntary manslaughter in Michael Jackson’s death asked a judge Friday to release him from jail pending his appeal.

Dr. Conrad Murray, who is serving a four-year jail sentence, said in a declaration that he should be released either on his own recognizance or on bail with electronic monitoring.

He said he is not a danger to society, will not flee the area, and wants to work to help support his seven children.

His lawyer, J. Michael Flanagan, said in the motion that Murray knows he cannot work as a doctor but would find other employment. He suggested the sentence and Murray’s mode of confinement is extremely severe for a man with no prior criminal record.

He said Murray is being held in solitary confinement and is chained to a table when he meets with his lawyers. He also said Murray is extremely sorrowful about Jackson’s death.

Jackson died in June 2009 from an overdose of the anesthetic propofol, administered by Murray. Flanagan conceded that Murray made some medical misjudgments but said he never intended harm to Jackson.

Murray’s appeal has not yet been filed, but the motion offered a preview of some issues that will be raised, including the claim that Superior Court Judge Michael Pastor should have allowed testimony about Jackson’s financial condition.

Flanagan said the exclusion of that evidence “seriously compromised the defendant’s ability to demonstrate the desperate situation which was guiding the decisions and choices of both Mr. Jackson and Dr. Murray.”

Murray appeared to be blaming Jackson for decisions that led to his death.

“Mr. Jackson was an uncooperative patient who made decisions and demands based upon his particular needs,” said Flanagan. “One of which was his extremely precarious financial situation complicated by drug addiction. “

Flanagan also cited the judge’s refusal to sequester the jury and the presence of cameras in the courtroom as appellate issues.

With Murray’s appeal expected to take more than a year to move through the courts, the attorney said it would be unfair to keep him jailed in the interim.

Under sentencing guidelines, Murray is expected to serve no more than half of his sentence. The attorney said if he served his complete sentence he would not receive the benefits of a favorable appeal decision if his case was overturned.

A hearing on the motion was set for Feb. 24.

Dr. Conrad Murray has just filed legal docs asking a judge to release him from jail pending appeal.

Murray claims in his legal docs he has a legitimate basis to appeal his manslaughter conviction. Among the grounds for appeal -- "improper exclusion of defense evidence and witnesses that resulted in violating the defendant's State and constitutional rights to due process, to present a defense and to the effective assistance of counsel."

Murray's lawyer also says, "He has exhausted virtually all of his available resources."

Murray is asking to be released on no bail pending the appeal.

If released, Murray says he plans to live with his baby mama Nicole Alvarez -- and would be willing to wear an electronic monitoring bracelet.

Murray says he would also seek employment to support his children -- though it's unclear what work that would entail ... considering his medical license has been unceremoniously revoked.

To illustrate his dire circumstances behind bars, Murray's lawyer says the ex-doctor is housed under "maximum security" conditions -- isolated in a solitary cell, and escorted around the jail facility with his hands chained to his waist.

According to CBS.com, Murray filed the paper work with Los Angeles Superior Court Judge Michael Pastor, claiming that his legal team has advised that the "appeal will take well over a year before an opinion is rendered."

"I am aware of the fact that I will have to serve out the remainder of my sentence less credit for the time I have served if I am not successful on appeal," wrote Murray.

He also says that he would "endeavor to seek employment within the parameters allowed by the court so that I could contribute to the support of each of my children."

There are nearly 4,000 inmates at L.A. County Men's Jail, so imagine the coincidence that Dr. Conrad Murray is in a cell just feet away from Michael Jackson's former brother-in-law.

James DeBarge -- Janet Jackson's ex-husband -- is locked up after being arrested for assault with a deadly weapon and drug charges. DeBarge -- who was the lead singer of the wildly popular band, El DeBarge -- has been placed in Administrative Segregation -- the place where famous inmates with security issues are housed.

Murray has been calling the Ad Segregation unit home since his conviction on manslaughter charges last November.

We're told they occasionally run into each other, most recently last Monday when they were each meeting with their respective lawyers in the visiting room.

DeBarge's lawyer, Spencer Vodnoy, tells TMZ ... the singer is "really upset" he's so close to Murray. DeBarge says even though he was married to Janet for less than a year back in '84, he thought of Michael as a brother.

El Debarge says his famous incarcerated brother has a serious beef with jailmate Conrad Murray ... but El is confident the two can eventually work things out ... if Conrad plays his cards right.

As TMZ first reported, James and Murray are both being housed in the Administrative Segregation of the L.A. County Men's Jail ... which is awkward since James was Michael Jackson's brother-in-law back when he was married to Janet Jackson in 1984.

El -- who was leaving Tru nightclub in Hollywood last night -- told us his brother is a very loving man ... but insists James was pissed at Murray over the circumstances regarding MJ's death. El tells us, "I don't really think they've had a chance to do a one-on-one talk and get an understanding ... I think once they finally do that, it'll be OK."

Still, El warns Conrad that forgiveness won't come easy ... "My brother James, he ain't no joke. My momma didn't raise no punk."

Look for El at the Grammys on Sunday because apparently he still makes music and was actually nominated.

Medical expert Dr. Steven Shafer was on the list to testify for the state in the Karri Willoughby capital murder trial.

Shafer testified in the Conrad Murray trial, where Murray was convicted in the death of pop star Michael Jackson.

Willoughby pleaded guilty to a lesser charge of murder in the lethal injection death of her stepfather, Billy Junior Shaw, and was sentenced to 20 years in prison. She will have to serve at least 15 years of her sentence before being considered for parole, according to a rule of the state Pardon and Parole board.

She was moved from DeKalb County Jail to start serving her sentence Friday at Tutwiler Prison for Women in Wetumpka.

Shafer is a professor of anesthesiology at Columbia University, an adjunct professor of anesthesia at Stanford University and an adjunct professor of bioengineering and therapeutic sciences at the University of California at San Francisco.

His work at Stanford included 10 years of studying the pharmacokinetics and pharmacodynamics of propofol, including propofol for sedation.

That work also included performing the modeling and simulation that is basis of the current FDA package insert on the use of propofol for sedation.

The International Society of Anesthetic Pharmacology recognized him with a lifetime achievement award last year for his work in anesthetic pharmacology.

The prosecution sent materials to Shafer, which he reviewed for four weeks.

"His report would knock your socks off," District Attorney Mike O'Dell said.

In the report, Shafer released a "proposed mechanism of death."

"It is impossible that Mr. Shaw gave himself an intravenous injection of propofol because"

a.) Mr. Shaw had no experience with injectable pharmaceuticals. It is difficult for an untrained individual to draw up 20 mls. of propofol into a syringe,

b.) Mr. Shaw would have difficulty placing a tourniquet on his arm. Such a tourniquet must be placed by the opposite hand, without assistance. This requires considerable coordination,

c.) Mr. Shaw would not be able to administer an intravenous injection with the opposite hand. This is a difficult maneuver even for a clinician trained to draw blood and administer drugs. It is inconceivable that, without training, Mr. Shaw could use one hand to administer a syringe of propofol to a vein in the opposite arm, particularly the autopsy demonstrated of a single, precise injection into both veins,

d.) Mr. Shaw would have been unconscious within one minute following the injection of 200 mg. of propofol. There is no possibility that he would have been able to remove the tourniquet, syringe and needle from the scene in the few seconds of consciousness he might have had following intravenous injection.

e.) Based on these observations, Mr. Shaw received an intravenous injection of propofol administered by someone else," Shafer said in his report.

Shafer said because of the level of propofol present in Shaw's body and because it was found in Shaw's urine, Shaw was alive at the time it was administered.

"If Mr. Shaw had been dead when the propofol was given, the level would have been zero because the propofol [would have been] all in the arm veins and [would not have] reached the heart, or would have been incredibly high because the propofol had been pushed by the injection from the arm vein all the way to the heart."

Also in the report, Shafer said he believe the vecuronium (Norcuron) was administered orally.

"Based on these observations, I believe the first event was oral administration of a combination of vecuronium and pseudoephedrine, with the expectation of death from paralysis, and falsely implying death from pseudoephedrine overdose," Shafer said. "However, because of the delayed onset and reduced efficacy of oral vecuronium, it was necessary to subdue Mr. Shaw, who had some residual strength. This was accomplished with an injection of [anectine] into an arm vein, resulting in paralysis within one minute. This was followed by an injection of propofol into a vein in the opposite arm. Because of his emphysema, and the effects of vecuronium and [anectine], Mr. Shaw's lungs had little oxygen at the time of the propofol injection. That explains the observed concentration and circulatory arrest within five minutes of the injection."

Shafer said his rejected theories include self-administration of the propofol, intravenous injection of the vecuronium and the explanation that the drugs were for veterinary use.

"The explanation by Ms. Willoughby that propofol, vecuronium and [anectine] were provided to Mr. Shaw for veterinary purposes is rejected," Shafer said in his report. "There is no documented use of these drugs for that purpose. According to Merck Veterinary Manual: "Cattle are much more susceptible to the effects of [anectine] than other species...It must be emphasized that [anectine] should never be used as an agent for euthanasia or for immobilization for castration without local or general analgesia."

In defense, Willoughby's attorney Bruce Gardner said he would have started by acknowledging that Shafer "probably knows as much or more about propofol in living people than anybody else," but his report on the mechanism of death is "outrageous."

"He, I doubt, has as much, if any, experience in forensic pathology," Gardner said. "He had no experience in post-mortem toxicology. The studies he cites are all very interesting. They also happen to deal with live patients in a clinical testing environment and have nothing to do with what he would expect to see in a person who had been dead and embalmed and in the ground for over a year. He assumes, also, the reliability of the numbers that have been given to him by the lab the state hired in Pennsylvania that gave the readings. Part of our defense would have been to cast considerable doubt on the accuracy of the amounts of propofol in Mr. Shaw's body."

Gardner said he also would've asked Shafer about his experience and knowledge of post-mortem redistribution.

"When the body dies, a substance such as propofol or any other potentially toxic substance is going to redistribute and possibly leak out," Gardner said. "Post-mortem blood is not the same as what's pumping through your body right now. Another thing, Dr. Shafter admits that he, in his laboratory findings, deals only with plasma. It's an aspect of blood but isn't blood. In his own studies, he admits [extrapolation] is very speculative.

"Our attack would have been to contest every assumption he made, by saying that the forensic numbers weren't reliable and arguing the amount of propofol Mr. Shaw was given."

Wow... Dr. Shafer got really famous.

I would need to read more details of this but some of it just called my attention on spot. First, the sentence.. 20 years x 4 years for Murray (I guess there are different aspects here) but looking only to this article the only difference may seem that one is not a doctor.

For people reading only this article it would looks like Murray got less time and less charges just because he is a doctor.

Also, some observations made by Shafer here is quite different from Murray's case. At Murray's case he says Murray administrated propofol after "death" and here with what seems similar findings he says it was before the death.

They didn't say when it happens, but gave me the impression that was a long time ago. Something does not add up...
